A RESOLUTION GRANTING A VARIANCE FROM
ORDINANCE NO. 6871, ARTICLE VIII, SECTIONS
3 (3) and 6, TO PERMIT CONSTRUCTION OF
ADDITION TO SINGLE FAMILY RESIDENCE ON LOTS
9 AND 10, BLOCK 1, HYDE PARK (11-60),
LOCATED AT 4360 WEST FLAGLER STREET, WITH
LOT COVERAGE OF 37% (30% PERMITTED), AND
WITH REAR SETBACK OF 12' (20' REQUIRED),
ZONED R-4 (MEDIUM DENSITY MULTIPLE) DISTRICT.
WHEREAS, the City Planning and Zoning Board of the
City of Miami, at its meeting on February 26, 1973, passed
and adopted by a 8 to 0 vote its Resolution No. 73-33,
recommending granting a variance from Ordinance No.
6871, Article VIII, Sections 3(3) and 6, as hereinafter
set forth; and this Commission deems it advisable in
the interest of the general welfare of the City of Miami
to grant this variance requested on the ground that due
to peculiar circumstances affecting this parcel of land
practical difficulties and unnecessary hardships would
impair the owner's rights to some reasonable use of the
property under a R-4 (Medium Density Multiple) District;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. That the application for a variance
from Ordinance No. 6871, Article VIII, Sections 3(3) and
6, to permit construction of addition to single family
residence on Lots 9 and 10, Block 1, HYDE PARK (11-60),
located at 4360 West Flagler Street, with lot coverage of
37% (30% permitted), and with rear setback of 12' (20'
required), zoned R-4 (Medium Density Multiple) District,
be and the same is hereby granted.

Section 2. This variance shall become null and
void unless the use is commenced within six months of
the effective date of this Resolution. Extension may
be granted by the City Manager pursuant to the provisions
of Article XXXI, Section 4, of Ordinance No. 6871.

The Miami Planing Board, at its meeting of February 26, 1973, Item
#5, following an advertised Hearing, adopted Resolution No. 73-33
by an 8 to 0 vote (one member absent), recommending Variance from
Ordinance No. 6871, ARTICLE VIII, Sections 3 (3) and 6, to permit
construction of addition to single family residence on Lots 9 and
10, Block 1, HYDE PARK (11-60), located at 4360 West Flagler Street,
with Lot Coverage of 37% (30% permitted), and with rear setback of
12' (20' required), zoned R-4 (Medium Density Multiple).
One objection was received in the mail.
A RESOLUTION to provide for this Variance has been prepared by the
City Attorney's office and submitted for consideration of the City
Commission.
