A RESOLUTION CONFIRMING ORDERING
RESOLUTION NO. 73-97, SAID RESOLUTION
BEING AN AMENDMENT TO ORDERING
RESOLUTION NO. 43179 ENTITLED "A
RESOLUTION ORDERING LEJEUNE GARDENS
HIGHWAY IMPROVEMENT H-4353; DESIGNATING
PROPERTY AGAINST WHICH SPECIAL ASSESS-
MENT SHALL BE MADE FOR A PORTION OF THE
COST THEREOF AS LEJEUNE GARDENS HIGHWAY
IMPROVEMENT DISTRICT H-4353; AND ALLOCATING
THE SUM OF $1,000.00 TO COVER THE PRELIMINARY
COSTS"; INCREASING THE SCOPE AND AMOUNT
OF THE CONTRACT WITH MARKS BROTHERS CO.,
FOR LEJEUNE GARDENS HIGHWAY IMPROVEMENT
H-4353; AND ALLOCATING AN ADDITIONAL SUM
OF $53,483.00 FROM THE HIGHWAY IMPROVEMENT
BOND FUND ACCOUNT.
WHEREAS, at the City Commission meeting of February 8,
1973, Resolution No. 73-97 was passed, which resolution amended
Ordering Resolution No. 43179 entitled "A RESOLUTION ORDERING
LEJEUNE GARDENS HIGHWAY IMPROVEMENT H-4353; DESIGNATING
PROPERTY AGAINST WHICH SPECIAL ASSESSMENT SHALL BE MADE FOR
A PORTION OF THE COST THEREOF AS LEJEUNE GARDENS HIGHWAY
IMPROVEMENT DISTRICT H-4353; AND ALLOCATING THE SUM OF $1,000.00
TO COVER THE PRELIMINARY COSTS"; and
WHEREAS, pursuant to due public notice, a public hearing
was held before the City Commission on March 8, 1973, to hear
objections to the confirmation of said Amending Resolution No. 73-97;
and
WHEREAS, the Bid has been awarded to Marks Brothers
Company for the construction of LeJeune Gardens Highway Improvement
H-4353; and
WHEREAS, pursuant to Resolution No. 73-97 the improvement
was increased to include N. W. 45 Avenue from N.W. 7 Street to
Comfort Canal; and

WHEREAS, the additional work is expected to cost an
additional $47,752.25 and funds are available for allocation from
Highway Bond Fund account;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI:
Section 1. That Ordering Resolution No. 73-97, adopted
February 8, 1973, which resolution amended Ordering Resolution
No. 43179 be, and the same is hereby confirmed;
Section 2. That the contract with Marks Brothers
Company for construction of LeJeune Gardens Highway Improvement
H-4353 be, and it is hereby, increased in scope and amount in
the estimated amount of $47,752.25 to include construction on
N. W. 45 Avenue from N. W. 7 Street to Comfort Canal which
was added to the Improvement by Resolution No. 73-97;
Section 3. That the sum of $53,483 be, and it is
hereby allocated from the Highway Bond Fund account to cover the
increased amount of the contract and the increased cost of
incidental expenses. / ��
