A RESOLUTION GRANTING A VARIANCE FROM
ORDINANCE NO. 6871, ARTICLE V, SECTION
3 (2)(a), TO PERMIT CONSTRUCTION OF
10' FENCE FOR PRIVATE TENNIS COURT
ON LOTS 4 AND 5, BLOCK 20, BAYSHORE
UNIT NO. 3, LOCATED AT 5555 NORTH BAYSHORE
DRfJE, TO BE 5' FROM NORTH BAYSHORE DRIVE
(75' REQUIRED BY SPECIAL YARD DISTRICT),
AND 5' FROM N. E. 55TH TERRACE (15'
REQUIRED); ZONED R-1 (ONE -FAMILY) DISTRICT.
WHEREAS, the City Planning and Zoning Board
of the City of Miami, at its meeting on February 5, 1973,
passed and adopted by a 9 to 0 vote its Resolution No.
73-23, recommending granting a variance from Ordinance
No. 6871, Article V, Section 3(2)(a), as hereinafter
set forth; and this Commission deems it advisable in
the interest of the general welfare of the City of Miami
to grant this variance requested on the ground that
due to peculiar circumstances affecting this parcel
of land practical difficulties and unnecessary hardships
would impair the owner's rights to some reasonable use
of the property under a R-1 (One -Family) District;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. That the application for a variance
from Ordinance No. 6871, Article V, Section 3(2)(a), to
permit construction of 10' fence for private tennis court on
Lots 4 and 5, Block 20, BAYSHORE UNIT NO. 3, located at 5555 -
North Bayshore Drive, to be 5' from North Bayshore Drive
(75' required by Special Yard District), and 5' from
N.E. 55th Terrace (15' required), zoned R-1 (One -Family)
District, be and the same is hereby granted.

Section 2. This variance shall become null
and void unless the use is commenced within six months
of the effective date of this Resolution. Extension
may be granted by the City Manager pursuant to the provisions
of Article XXXi, Section 4, of Ordinance No. 6871.

Applicant: Arthur Epstein
The Miami Planning Board, at its meeting of February 5, 1973, Item
#2, following an advertised Hearing, adopted Resolution No. 73-23
by a 9 to 0 vote recommending Variance from Ordinance No. 6871,
ARTICLE XXVI, Section 7 (e) and ARTICLE V, Section 3 (2) (a), to
permit construction of 10' fence for private tennis court on Lots
4 and 5, Block 20, BAYSHORE UNIT NO. 3, located at 5555 North
Bayshore Drive, to be 5' from North Bayshore Drive (75' required
by Special Yard District), and 5' from N. E. 55th Terrace (15' re-
quired); zoned R-1 (One -Family).
No objections were received in the mail.
A RESOLUTION to provide for this Variance has been prepared by the
City Attorney's office and submitted for consideration of the City
Commission.
