A RESOLUTION AMENDING RESOLUTION NO. 43179
ENTITLED "A RESOLUTION ORDERING LEJEUNE
GARDENS HIGHWAY IMPROVEMENT H-4353; DESIG-
NATING PROPERTY AGAINST WHICH SPECIAL
ASSESSMENT SHALL BE MADE FOR A PORTION OF
THE COST THEREOF AS LEJEUNE GARDENS HIGHWAY
IMPROVEMENT DISTRICT H-4353; AND ALLOCATING
THE SUM OF $1,000.00 TO COVER THE PRELIMIN-
ARY COSTS" BY INCLUDING N. W. 45 AVENUE FROM
N. W. 7 STREET TO COMFORT CANAL IN THE
LEJEUNE GARDENS HIGHWAY IMPROVEMENT DISTRICT
H-4353; AND DESIGNATING THE PROPERTIES AGAINST
WHICH SPECIAL ASSESSMENT SHALL BE MADE FOR A
PORTION OF THE COST THEREOF AS ADDITIONAL LOTS
AND PARCELS IN LEJEUNE GARDENS HIGHWAY IMPROVE-
MENT DISTRICT H-4353.
WHEREAS, Resolution No. 43179, passed and adopted by
the City Commission on January 20, 1972, ordered LEJEUNE
GARDENS HIGHWAY IMPROVEMENT H-4353 and designated properties
against which special assessment was to be made for a portion
of the cost thereof as LEJEUNE GARDENS HIGHWAY IMPROVEMENT
DISTRICT H-4353; and
WHEREAS, after this improvement was ordered, it was found
that N. W. 45 Avenue from N. W. 7 Street to Comfort Canal
needed to be improved in order to bring it up to proper grade;
and
WHEREAS, special assessments for a portion of the cost
of the construction of highway improvements will be levied
against the properties described in the paragraph above abut-
ting said street;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:

Section 1. That N. W. 45 Avenue from N. W. 7 Street
to Comfort Canal is hereby included in the LEJEUNE GARDENS
HIGHWAY IMPROVEMENT H-4353.
Section 2. That the properties 'abutting N. W. 45 Avenue
from N. W. 7 Street to Comfort Canal shall be assessed for a
portion of the cost of LEJEUNE GARDENS HIGHWAY IMPROVEMENT
H-4353.
Section 3. That the proper City officials are hereby
authorized and directed to levy special assessments to the
properties described in Section 2 above for a portion of the
cost of construction of the highway improvements abutting
said properties, as if said properties had been included in
the original resolution ordering the LEJEUNE GARDENS HIGHWAY
IMPROVEMENT H-4353 in LEJEUNE GARDENS HIGHWAY IMPROVEMENT
DISTRICT H-4353.
