HomeMy WebLinkAboutR-73-0092RESOLUTION NO. 73-92 A RESOLUTION GRANTING A "CONDITIONAL USE", AS PROVIDED IN ORDINANCE NO. 6871, ARTICLE V, SECTION 1(6)(b), TO PERMIT OFF-STREET PARKING ON LOTS 20, BLOCK 21, HIGHLAND PARK (2-13), LOCATED AT APPROXIMATELY 1615 N. W. 9TH AVENUE, IN CONJUNCTION WITH NATIONAL PARKINSON FOUNDATION AT 1501 N. W. 9TH AVENUE, PARKING NOT TO BE USED FOF. REQUIRED PARKING, AND SUBJECT TO SITE PLAN APPROVAL BY PLANNING DEPARTMENT, SITE ZONED R-4 (MEDIUM DENSITY MULTIPLE) DISTRICT, SUBJECT TO CERTAIN TERMS & CONDITIONS WHEREAS, the City Planning and Zoning Board of the City of Miami, at its meeting held on Jlnuafy 21, 1973, passed and adopted by a 8 to 0 vote its Resolution No. 73-16, recommending granting a "conditional use" as provided in Ordinance No. 6871, Article V, Section 1(6)(b), (:s hereinafter set forth; and this Commission deems it advisable to the public convenience and welfare and finds that the use will not be detrimental or injurious to the character or the development of the immediate neighborhood; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That the application for a"conditional use" as provided in Ordinance No. 6871, Article V, Section 1(6)(b), to permit off-street parking on Lot 20, Block 21, HIGHLAND PARK (2-13), located at approximately 1615 N. W. 9th Avenue, in conjunction with National Parkinson Foundation at 1501 N. W. 9th Avenue, parking not to be used for required parking, and subject to site plan approval by Planning Oopartment, site zoned R-4 (Medium Density Multiple) District, be and the same is hereby granted, subject to dedication of five-foot strip of land along the property abutting N.W. 9th Avenue to the City of Miami for street purposes. - 415 131' Section 2. The conditional use granted herein is subject to compliance with the lighting requirements for parking lots as set out in Ordinance No. 8115 of the City of Miami, dated November 16, 1972. Section 3.; This conditional use shall become null and void unless the use is commenced within six months of the effective dateof this Resolution. Upon application, the City Manager may, after review and determination that substantial progress has been achieved by the applicant in terms of project planning, extend the expiration date of the conditional use for an additional period of time i not to exceed one (1) year. Said extension request shall be filed with the City Manager two (2) weeks prior to the expiration date of the initial six (6) months effective period of the conditionals use. W. 9th Avenue Lot 20, Block 21, HIGHLAND PARK (2-13) Applicant: National Parkinson Foundation Gentlemen: The Miami Planning Board, at its meeting of January 22, 1973, Item #4 (c), following an advertised Hearing, adopted Resolution No. 73-16 by an 8 to 0 vote (one member absent), recommending "Conditional Use" as listed in Ordinance No. 6871, ARTICLE V, Section 1 (6) (b), to permit off-street parking on Lot 20, Block 21, HIGHLAND PARK (2-13), located at approximately 1615 N. W. 9th Avenue, in conjunction with National Parkinson Foundation at 1501 N. W. 9th Avenue, parking not to be used for required parking, zoned R-4 (Medium Density Multiple), subject to site plan for review by the Planning Department. No objections were received in the mail. A RESOLUTION to provide for this "CONDITIONAL USE" has been prepared by the City Attorney's office and submitted for consideration of the City Commission. sincerely David Simpson, tr.
