A RESOLUTION GRANTING A VARIANCE FROM ORDINANCE NO. 6871, ARTICLE VIII, SECTIONS 6 and 3(2)(c), AND ARTICLE XXIII, SECTIONS 4(8) AND 4(22), TO PERMIT CONSTRUCTION OF ADDITION TO NATIONAL PARKINSON FOUNDATION STRUCTURE, ON LOTS 15 THRU 18 AND W 40' LOTS 13 AND 14, BLOCK 21, HIGHLAND PARK (2-13), LOCATED AT 1501 N. W. 9TH AVENUE, WITH LOT COVERAGE OF 47.3% (28% PERMITTED), WITH SETBACK ON N.W. 15TH STREET OF 10' (20' REQUIRED), WITH REAR SETBACK OF 0' (20' REQUIRED), WAIVING 88 OF 113 REQUESTED OFF-STREET PARKING SPACES, STRUCTURE UNDER CONCURRENT PETITION FOR "CONDITIONAL USE", ZONED R-4 (MEDIUM DENSITY MULTIPLE) DISTRICT. WHEREAS, the City Planning and Zoning Board of the City of Miami, at its meeting on January 22, 1973, passed and adopted by a 4 to 4 votes its Resolution No. 73-15, recommending denial for a variance from Ordinance No. 6871, Article VIII, Sections 6 and 3(2)(c), and Article XXIII, Sections 4(8) and 4(22), as hereinafter set forth; and this Commission deems it advisable in the interest of the general welfare of the City of Miami to grant this variance requested on the ground that due to peculiar circumstances affecting this parcel of land practical difficulties and unnecessary h,rdships would impair the owner's rights to some reasonable use of the property under a R-4 (Medium Density Multiple) District; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That the application for a variance from Ordinance No. 6871, Article VIII, Sections 6 and 3(2)(c), and Article XXIII, Sections 4(8) and 4(22), to permit construction of addition to 'rational Parkinson Foundation 1341 structure, on Lots 15 thru 18 and W 40' Lots 13 and 14, Block 21, HIGHLAND PARK (2-13) located at 1501 n.w. 9th Avenue, with lot coverage of 47.3% (28% permitted), with setback on N.W. 15th Street of 10' (20' required), with rear setback of 0' (20' required), waiving 88 of 113 off- street parking spaces, structure under concurrent petition for "conditional use", zoned R-4 (Medium Density Multiple) District, be and the same is hereby granted. Section 2. This variance shall become null and void unless the use is commenced within six months of the effective date of this Resolution. Extension may be granted by the City Manager pursuant to the provisions of Article XXXI, Section 4, of Ordinance No. 6871.
