AN ORDINANCE AMENDING ARTICLE III, CHAPTER 20,
OF THE CODE OF THE CITY OF MIAMI, FLORIDA, ENTITLED
"REMOVAL OF ABANDONED PROPERTY FROM PUBLIC AND
PRIVATE PROPERTY" FOR THE PURPOSE OF ADOPTING BY
REFERENCE ALL OF THE PROVISIONS OF SEC. 705.16,
FLORIDA STATUTES, AS AMENDEo, APPLICABLE TO THE

BE IT ORDAINED 'Y TUE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Article : II, Chapter 20, of The Code os:
the City of Miami, Florilz3.; entitled "Removal of Abandoned
Property from Public arc; Private Property" is hereby amended
to read as follows:

Sec. 20-25. l.dopti.ur. cif General State Law.
All of the provisions of Sec. 705.16, Florida
Statutes, as amended, e.pplicable to the City of
Miami, are adopted by reference.
Sec. 20--26. Aba;idGned Property on Private FIroperty.
It eha11 be L.r.iawful to park, store or leave any
abandoned property ea defiled in Sec. 2(b), Sec.
705.16, Florida Statutes, as amended, on private
property in the City unless it is in connec-
tion 1:ith a purl;ose or bu3..r ess enterprise lawfully
situated and 1icenec. This section is intended to
provide file City of I.1Lini a local government ordinance

forcement officer of she City of Miami to institute
the c:44u in Section 4(a) and
(b) thereof.
Sec. 20-27. Enforcaivent Officers.
The following are designated enforcement officers
for the purpose of e.forciny the provisions of Sec. •
705.16, Florida Statutes, as amended, and the provisions
of this article: the Chief of Police, the Director of
the Department of Yacht Docks, the Director of the Department
of Sanitation.
Section 2. A copy of Sec. 705.16, Florida Statutes,
as amended, is attached hereto and made a part hereof and
the content of same is to be included in an appropriate
footnote in the Code of the City of Miami, Florida.
Section 3. The rights, powers and procedures set forth
in this ordinance are supplemental to and cumulst:.ve of any
other rights, powers and procedures available to the City
of Miami for the acc7.t;plieivasnt of a similar or like purpose.
Section 4. If any section, sentence, clause, phr�c
or word of this ordinance is for any reason held or declared
to be unconstitutional, ii.operative or void, such holding
or invalidity shall not Lect the remaining portions of
this ordinance; and it sncil be construed to have been the
intent of The Cot iin ion of ties City of Miami to pass this
ordinance without such unconstitutional, invalid or inopera-
tive part therein; and the remainder of this ordinance, after
the exclusion of such part or parts shall be deemed and held
to be valid as if such pa:tu had not been included therein.
Section 5. r1:,." effoctive date of this ordinance shall
be 45 days from the date of its adoption.

December, 1972.

705.17 Exceptions
The provisions of §§ 705 01 through 705.1E of•this chapter shall not be applied to
any personal property lost or abandoned on the campus; of any institution in the tate
university system.

705.18 Disposal of personal property 1os: or abandoned on university
campuses and the disposition of any proceeds from sale thereof
(1) Whenever any lost or abandoned personal property shall be found on a campus
of an institutiun in the state university .y;,tem the president of the respective
institution or his designee shall take charge thereof and snake a record of the date
such property was found. If, within thirty days after such property is found, it is not
claimed by the owner, the presicent shalt ort'.cr it sold at public outcry after giving
notice of the time and place of sale in a publication general circulation on the
campus and written notice to the owner is 1tnoK n. The rightti:1 owner of such property
may reclaim same at any time prior to sale.
(2) All moneys realized from such sale shall be placed to int appropriate fund and
used solely for student scholarship and losn purposes

Section 1. Article III, Chapter 20, of The Code of
the City of Miami, Florida, entitled "Removal of Abandoned
Property from Public and Private Property" is hereby amended
to read as follows:
Article III. Removal of Abandoned Property from
Public and Private Property.
Sec. 20-25. Adoption of General State Law.
All of the provisions of Sec. 705.16, Florida
Statutes, as amended, applicable to the City of
Miami, are adopted by reference.
Sec. 20-26. Abandoned Property on Private Property.
It shall be unlawful to park, store or leave any
abandoned property as defined in Sec. 2(b), Sec.
705.16, Florida Statutes, as amended, on private
property in the City of Miami unless it is in connec-
tion with a purpose or business enterprise lawfully
situated and licensed. This section is intended to
provide the City of Miami a local government ordinance
or regulation (in addition to any other City of Miami

Sec. 20-27. Enforcement Officers.
The following are designated enforcement officers
for the purpose of enforcing the provisions of Sec.
705.16, Florida Statutes, as amended, and the provisions
of this article: the Chief of Police, the Director of
the Department of Yacht Docks, the Director of the Department
of Sanitation.
Section 2. A copy of Sec. 705.16, Florida Statutes,
as amended, is attached hereto and made a part hereof and
the content of same is to be included in an appropriate
footnote in the Code of the City of Miami, Florida.
Section 3. The rights, powers and procedures set forth
in this ordinance are supplemental to and cumulative of any
other rights, powers and procedures available to the City
of Miami for the accomplishment of a similar or like purpose.
Section 4. If any section, sentence, clause, phrase
or word of this ordinance is for any reason held or declared
to be unconstitutional, inoperative or void, such holding
or invalidity shall not affect the remaining portions of
this ordinance; and it shall be construed to have been the
intent of The Commission of the City of Miami to pass this
ordinance without such unconstitutional, invalid or inopera-
tive part therein; and the remainder of this ordinance, after
the exclusion of such part or parts shall be deemed and held
to be valid as if such parts had not been included therein.

When personal property not subject to summary destruction is seized by the sheriff
pursuant to any of the provisions of tht' law in this state permitting forfeiture ol't:aid

the name of the owners of said property or the names of any person, firm or

705.17 Exceptions
The provisions of §§ 705.01 through 705.16 of this chapter shall not be applied to
any personal property lost or abandoned on the campus of any institution in the state
university system.

705.18 Disposal of personal property lost or abandoned on university
campuses and the disposition of any proceeds from sale thereof
(1) Whenever any lost or abandoned personal property shall be found on a campus
of an institution in the state university system the president of the respective
institution or his designee shall take charge thereof and make n record of the date
such property was found. if, within thirty days after such property is found. it is not
claimed by the owner. the president shall order it sold at public outcry after giving
notice of the time and place of sale in a publication of general circulation on the
campus and written notice to the owner if known. The rightfW owner of such property
ma.y reclaim same at any time prior to sale.
(2) All moneys renlwed from such sale shall be placed in an appropriate fund :and
used solely for student scholarship and loan purposes.
