HomeMy WebLinkAboutItem #08 - Discussion Item~ ..~ R E S O L '1 Y I 0 I~ WHEREAS, the City of Miami Civil Service Board, at their meeting on January l6, 1973, was informed through a legal opinion from the City Attorney that Che existing Civil Service Rule XIV, Sections 1 and 2 covering Lay-Off, Resignations and Reinstatements does not grant retention rights to employees in the event of a transfer to Pietro- politan Dade County or when their job is abolished and, . w'IIEREAS, the Civil Service Board has always interpreted the present rule to grant such rights and all other abolishment:, of functions and transfers to Metropolitan Government have been carried out under these provisions without objections by any of the parties involved and, WHEREAS, present employees have a right to zely on and be granted the same protections previously granted to all other employees and, k'HEREAS, the Civil Service hoard 'has proposed a rule change which would more specifically J~° give rights based. on City-wide seniority and classification and, WHEt7F.~sS, the Civil Service board feels that this cutter must be corrected prior to the April 1, 1973 date of transfer of the l,'ater & Sewers Department and, WFiE~S, the Civil Service Board will hold a public hearing on this rule change on February 1, 1973 in order that this rule change :.,ay be considered by the City of Miami City Commission on February 8, 1973 and, o~ p~ ne ~P =r ._~ _~ , kiIEREAS, it is the request that this be considered as an emergency rule change. NOW THEREFORE, be it resolved that the Civil Service Board of the City of Miami request the City Cocvnission to pass a resolution ditectinb that 'the City Law Department and the City Manager have this rule ciianbe presented at the meeting of February 8, 1973. i'ASSED r1tiD ADOPTED this 16 day of January, 1973.
