RESOLUTION NO.
A RESOLUTION GRANTING A VARIANCE
FROM ORDINANCE NO. 6871, ARTICLE VII,
SECTIONS 2 (3) , 3 (2) (a) , and 3 (2)
(b), TO PERMIT CONSTRUCTION OF DUPLEX
ON LOT 1, BLOCK 3, SPRING GARDENS (5-38) ,
LOCATED AT APPROXIMATELY 901 N. W. 8TH
STREET ROAD, WITH LOT AREA OF 3,500 SQ. FT.
(4,000 SQ. FT. REQUIRED) , WITH SIDE STREET
SETBACK OF 10' (15' REQUIRED) , WITH SIDE
SETBACK OF 5' (9' REQUIRED) ZONED R-3
(LOW DENSITY MULTIPLE).
WHEREAS, the City Planning and Zoning Board of
the City of Miami, at its meeting of December 18, 1972,
passed and adopted by a 7 to 1 vote its Resolution No.
72-281, recommending granting of variance from Ordinance
No. 6871, Article VII, Section 2 (3) , 3 (2) (a) , and
3 (2) (b) , as hereinafter set forth; and this Commission
deems it advisable in the interest of the general welfare
of the City of Miami to grant this variance requested on
the ground that due to peculiar circumstances affecting
this parcel of land practical difficulties and unnecessary
hardships would impair the owner's rights to some
reasonable use of the property under a R-3 (Low Density
Multiple) District.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. That the application for a variance
from Ordinance No. 6871, Article VII, Sections 2 (3),
3 (2) (a) and 3 (2) (b) , to permit construction of Duplex

on Lot 1, Block 3, SPRING GARDENS (5-38), located at
approximately 901 N. W. 8th Street Road, with lot area
of 3,500 sq. ft. (4,000 sq. ft. required) , with side
street setback of 10' (15' requiredl with side setback
of 5' (9' required) , zoned R-3 (Low Density Multiple) ,
be and the same is hereby granted.
Section 2. This variance shall become null
and void unless the use is commenced within six months
of the effective date of this Resolution. Extension may
be granted by the City Manager pursuant to the provisions
of Article ?XXI, Section 4, of Ordinance No. 6871.

Gentlemen:
The Miami Planning Board, at its meeting of December 18, 1972, Item
#6, following an advertised Hearing, adopted Resolution No. 72-281
by a 7.__to_l vote (one member absent), recommending Variance from
Ordinance No. 6871, ARTICLE VII, Sections 2 (3), 3 (2) (a), and 3 (2)
(b), to permit construction of Duplex on Lot 1, Block 3, SPRING
GARDENS (5-38), located at approximately 901 N. W. 8th Street Road,
with lot area of 3,500 sq. ft. (4,000 sq. ft. required), with side
street setback of 10' (15' required), with side setback of 5' (9'
required); zoned R-3 (Low Density Multiple).
Three objections were received in the mail.
A RESOLUTION to provide for this Variance has been prepared by the
City Attorney's office and submitted for consideration of the City
Commission.
