HomeMy WebLinkAboutR-73-0014RHT/cc 1/4/73 RESOLUTION NO. 73 /y A RESOLUTION GRANTING A "CONDITIONAL USE" AS PROVIDED IN ORDINANCE NO. 6871, ARTICLE XI-2, SECTION 1 (7) (d) , TO PERMIT EMPLOYEE CAFETERIA IN STRUCTURE ON THAT PART OF LOTS 14 and 15 WEST OF BAYSHORE DRIVE, BLOCK 104S, BRICKELL ADD AMD (B-113) LOCATED AT 999 BRICKELL AVENUE, SUBJECT TO NO COMMERCIAL ACTIVITY TO BE VIEWED FROM PUBLIC RIGHT-OF-WAY, ZONED R-CB (RESIDENCE - OFFICE) . WHEREAS, the City Planning and Zoning Board of the City of Miami, at its meeting held on December 18, 1972, passed and adopted by an 8 to 0 vote its Resolution No. 72-286, recommending granting a "conditional use" as provided in Ordinance No. 6871, Article XI-2, Section 1 (') (d) , as hereinafter set forth; and this Commission deems it advisable to the public convenience and welfare and finds that the use will not be detrimental or injurious to the character of the development of the immediate neighborhood; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI , FLORIDA: Section 1. That the application for a "conditional use" as provided in Ordinance No. 6871, Article XI-2, Section 1 (7) (d), to permit employee Cafeteria in structure on that part of Lots 14 and 15 west of Bayshore Drive, Block 104S, BRICKELL ADD AMD (B-113), located at 999 Brickell Avenue, 734- subject to no commercial activity to be viewed from Public Right-of-way, zoned R-CB (Residence -Office), be and the same is hereby granted. Section 2. This conditional use shall become null and void unless the use is commenced within six months of the effective date of this Resolution. Upon application, the City Manager may, after review and determination that substantial progress has been achieved by the applicant in terms of project planning, extend the expiration date of the conditional use for an additional period of time not to exceed one (1) year, Said extension request shall be filed with the City Manager two (2) weeks prior to the expiration date of the initial six (6) months effective letperiod of the conditional use. Citizens Federal Gentlemen: The Miami Planning Board, at its meeting of December 18, 1972, Item #9 (c), following an advertised Hearing, adopted Resolution No. 72-286 by an 8 to 0 vote (one member absent) recommending "Conditional Use" as listed in Ordinance No. 6871, ARTICLE XI-2, Section 1 (7) (d), to permit employee Cafeteria in structure on that part of Lots 14 and 15 west of Bayshore Drive, Block 104S, BRICKELL ADD AMD (B-113), located at 999 Brickell Avenue, subject to no commercial activity to be view- ed from Public right-of-way, zoned R-CB (Residence -Office). One objection was received in the mail. A RESOLUTION to provide for this "Conditional Use" has been prepared • by the City Attorney's office and submitted for consideration of the City Commission.
