A RESOLUTION GRANTING A VARIANCE
FROM ORDINANCE NO. 6871, ARTICLE XI-2,
SECTION 9 (2), TO PERMIT CONSTRUCTION
OF BANK AND OFFICE BUILDING ON THAT
PART OF LOTS 14 AND 15 WEST OF BAYSHORE
DRIVE, BLOCK 104S, BRICKELL ADD AMD
(B-113), LOCATED AT 999 BRICKELL AVENUE,
WITH PORTION OF ACCESSORY PARKING STRUCTURE
31.37 ' HIGH (30' PERMITTED) ZONED
R-CB (RESIDENCE -OFFICE). •

WHEREAS, the City Planning and Zoning Board of
the City of Miami, at its meeting of December 18, 1972,
passed and adopted by a 5 to 3 vote its Resolution No.
72-285, recommending granting of variance from Ordinance
No. 6871, Article XI-2, Section 9 (2), as hereinafter
set forth; and this Commission deems it advisable in the
interest of the general welfare of the City of Miami to
grant this variance requested on the ground that due
to peculiar circumstances affecting this parcel of land
practical difficulties and unnecessary hardships would
impair the owner's rights to some reasonable use of the
property under a R-CB (Residence -office) District.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. That the application for a variance
from Ordinance No. 6871, Article XI-2, Section 9 (2)
t.o permit construction of bank and office building on
that part of Lots 14 and 15 west of Bayshore Drive,

Block 104S, BRICKELL ADD AMD (B-113), located at
999 Brickell Avenue, with portion of accessary parking
structure 31.37' high (30' permitted), zoned R-CB
(Residence -Office), be and the same is hereby granted.
Section 2. This variance shall become null
and void unless the use is commenced within six months
of the effective date of this Resolution. Extension may
be granted by the City Manager pursuant to the provisions
of Article XXXI, Section 4, of Ordinance No. 6871.

Gentlemen:
The Miami Planning Board, at its meeting of December 18, 1972, Item
#9 (b), following an advertised Hearing, adopted Resolution No. 72-285
by a 5_to 3 vote (one member absent), recommending Variance from
Ordinance No. 6871, ARTICLE XI-2, Section 9 (2), to permit construc-
tion of bank and office building on that part of Lots 14 and 15 west
of Bayshore Drive, Block 104S, BRICKELL ADD AMD (B-113), located at
999 Brickell Avenue,with portion of accessory parking structure
31.37' high (30' permitted), zoned R-CB (Residence -Office).
One objection was received in the mail.
A RESOLUTION to provide for this Variance has been prepared by the
City Attorney's office and submitted for consideration of the City
Commission.
