RESOLUTION NO. 73 -- / ,
A RESOLUTION GRANTING A VARIANCE
FROM ORDINANCE NO. 6871, ARTICLE VII,
SECTIONS 2 (3) and 3 (3), AND ARTICLE
XXIII, SECTION 2 (5), TO PERMIT CON-
STRUCTION OF 3-UNIT APARTMENT BUILDING
ON LOT 21, BLOCK 44, RIVERSIDE FARMS
SUPPLEMENT (2-88), LOCATED AT 752
N. W. 22ND AVENUE, WITH LOT AREA OF
4,250 SQ. FT. (4,500 SQ. FT. REQUIRED),
WITH REAR SETBACK OF 15' (20' REQUIRED),
WITH 3' OF LANDSCAPED AREA IN FRONT
(7.5' REQUIRED); ZONED C-1 (LOCAL
COMMERCIAL) .
WHEREAS, the City Planning and Zoning Board of
the City of Miami, at its meeting on November 20, 1972, passed
and
adopted by a 6 to 3 vote its Resolution No. 72-251, recommending
granting variance from Ordinance No. 6871, Article
VII, Sections 2 (3) and 3 (3), and Article XXIII, Section
2 (5), as hereinafter set forth; and this Commission
deems it advisable in the interest of the general welfare
of the City of Miami to grant this variance requested
on the ground that due to peculiar circumstances affecting
this parcel of land practical difficulties and unnecessary
hardships would impair the owner's rights to some reasonable
use of -he property under a C-1(Local Commercial) District;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. That the application for a variance
from Ordinance No. 6871, Article VII, Sections 2(3)
and 3 (3), and Article XXIII, Section 2 (5), to permit
construction of 3-Unit Apartment Building on Lot 21,
Block 44, Riverside Farms Supplement (2-88), located

at 752 N. W. 22nd Avenue, with lot area of 4,250 sq.
ft. (4,500 sq. ft. required) , with .rear setback of
15' (20' required), with 3' of landscaped area in front
(7.5' required); zoned C-1 (Local Commercial), be and
the same is hereby granted.
Section 2. This variance shall become null
and void unless the use is commenced within six months
of the effective date of this Resolution. Extension
may be granted by the City Manager pursuant to the
provisions of of Article XXXI, Section 4, of Ordinance
No. 6871.

Section-2,(5), to permit construction of 3-unit apartment build-
ing on Lot 21, Block 44, RIVERSIDE FARMS SUPPLEMENT (2-88), located
at 752 N. W. 22nd Avenue, with lot area of 4,250 sq. ft. (4,500 sq.
ft. required), with rear setback of 15' (20' required), with 3' of
landscaped area in front (7.5' required); zoned C-1 (Local
Commercial).
One objection was received in the mail.
A R.ESOJ,UTION to provide for this Variance has been prepared by the
City Attorney's office and submitted for consideration of the City
Commission.
