RESOLUTION No. 74-1363_
A RESOLUTION AUTHORIZING THE CITY MANAGER TO
PURCHASE BY NEGOTIATION IN LIEU OF CONDEMNA-
TION PARCEL NO. 1537.3 Off' THE CITY OF MIAMI
EATON PARK EXPANSION, AS DETCRIBED HEREIN, FOR
THE SUM OF $38,300; AND ALLOCATING $40, 000 FROM
THE 1972 PARKS AND RECREATIONAL FACILITIES BOND
FUND TO COVER THE COST OF ACQUISITION OF FEE
SIMPLE TITLE TO THIS PROPERTY AND OTHER COSTS
INCIDENTAL TO THE ACQUISITION.
WHEREAS, Parcel No. 1537.3 is a portion of the
property proposed to be acquired for the expansion of Eaton,
Park; and
WHEREAS, the citizens of the City of Miami approved
the issuance of bonds to provide the funds to defray the cost
of such property acquisition to provide for parks under the
Parks for People Bond Program; and
WHEREAS, the necessary monies for said acquisition
are available in the 1972 Parks and Recreational Facilities
Bond Fund; and
WHEREAS, the owner of Parcel No. 1537.3 has by
agreement dated November 25, 1974, offered to convey Fee Simple
Title to this property to the City of Miami for $38,300; and
WHEREAS, the present owner shall have the right to
remain on the property and receive all proceeds from the use
of the property until May 1, 1975, upon which date the
property will be vacated and delivered to the City of Miami;
and
WHEREAS, the. Law Department has approved the offer
subject to..certain modifications securing the City's right to
obtair;s possession on May--,lst, 1975; and

WHEREAS, it is deemed in the best interest of the
City of Miami, Florida, to acquire this property at this time
through negotiated purchases
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF M=AMC FLORIDA:
Section 1. The City Manager be, and he is hereby
authorized and directed to purchase Parcel No. 1537.3 of the
Eaton Park Expansion Project in accordance with the owner;s'
offer and subject to the modification recommended by the Law
Department to secure the City's right to possession, for the
sum of $38,300 and pay $1,000 of this amount to the owner's
attorney upon acceptance of this offer as an escrow deposit for
the following described parcel:
A11 of Lot 31 of White's Lemon City,
as recorded in Plat Book B at page
32 of the Public Records of Dade
County, Florida, plus a 50 foot wide
stip of land 50 feet long, south of
and abutting the south line of said
Lot 31.
Section 2. The amount of $40,000 is hereby
allocated from the 1972 Parks and Recreational Facilities Bond
Fund to cover the cost of acquisition of Fee Simple Title to
this property and other costs incidental to the acquisition.

1974.
