RESOLUTION NO. 74.-1362
A RESOLUTION AUTHORIZING RELEASE OF MARY
WEBSTER FROM FURTHER OBLIGATION TO THE CITY
OF MIAMI UNDER HER AGREEMENT DATED SEPTEMBER
21, 1973, TO CONSTRUCT ASPHALTIC CONCRETE
PAVEMENT, REMOVAL OF EXISTING PAVEMENT, GRADING
AND SHAPING STREET SHOULDER, ONE STORM DRAIN-
AGE STRUCTURE, REMOVAL OR RELOCATION OF
THIRTEEN TREES AND LANDSCAPING AT WEBSTER
SUBDIVISION; AND AUTHORIZING THE RELEASE OF
THE PERFORMANCE BOND IN THE AMOUNT OF $15,600.00
EXECUTED BY MARY WEBSTER, AS PRINCIPAL, AND THE
FIDELITY AND DEPOSIT COMPANY OF MARYLAND, AS
SURETY, TO GUARANTEE THE COMPLETION OF THE ABOVE
MENTIONED IMPROVEMENTS; AND AUTHORIZING THE
ACCEPTANCE OF A NEW AGREEMENT EXECUTED BY EMIL
J. GOULD, AS PRINCIPAL, AND A NEW PERFORMANCE
BOND IN THE AMOUNT OF $17,600.00 EXECUTED BY THE
CONTINENTAL CASUALTY COMPANY, AS SURETY, TO
GUARANTEE THE COMPLETION OF THE ABOVE MENTIONED
IMPROVEMENTS.
WHEREAS, on November 8, 1973, the City Commission
passed and adopted Resolution No. 73-898 accepting the plat
entitled WEBSTER SUBDIVISION and an Agreement executed by
Mary Webster agreeing to construct the following listed
improvements: asphaltic concrete pavement, removal of existing
pavement, grading and shaping street shoulder, one storm
drainage structure, removal or relocation of thirteen trees
and landscaping. The aforementioned plat has now been
recorded in Plat Book 99, at Page 96, of the Public Records of
Dade County, Florida; and
WHEREAS, byeauthority of the above mentioned
resolution, the City Commission also accepted a Covenant to
Run with the Land executed by Mary Webster postponing the
immediate construction of standard sidewalk, curb and gutter,
and full width pavement adjacent to the westerly 46 feet of
Lot 3 of said subdivision. This Covenent was recorded in
OR 8788, Pages 639 and 640 of the Public Rec dB Of Dade

WHEREAS, title to the property platted has now
been transferred by the original fee simple owner, Mary Webster,
to Emil J. Gould, and the Director of the Department of Public
Works recommends that the new Agreement executed by said Emil
J. Gould be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. That Mary Webster be, and she is hereby
released from further obligation to the City of Miami under her
Agreement dated September 21, 1973, to construct asphaltic
concrete pavement, removal of existing pavement, grading and
shaping street shoulder, one storm drainage structure, removal
or relocation of thirteen trees and landscaping at Webster
Subdivision; and authorizing the release of the performance
bond in the amount of $15,600.00 executed by Mary Webster, as
Principal, and the Fidelity and Deposit Company of Maryland,
surety, to guarantee the completion of the above mentioned
iLmprovements.
Section 2. That the new subdivision improvement
Agreement executed by Emil J. Gould, as Principal, and the
Performance Bond in the amount of $17,600.00 executed by the
Continental Casualty Company, as Surety, be, and they are
hereby accepted to guarantee the completion of the subdivision
improvements at WEBSTER SUBDIVISION, copies of said Agreement
and Bond being attached hereto and made a part -hereof.:'-'
