CONFLICT HEREWITH. WHEREAS, Section 19A of the Charter of the City of Miami provides that the Commission may create new departments or discontinue any department and determine, combine, and dis- tribute the functions and duties of departments and subdivisions thereof; and WHEREAS, it is the desire of the Commission to exercise such authority and to create a new department to be knowias the Department of Management Services, and to distribute and transfer to it certain functions and duties heretofore performed by the Office of the City Manager, Budget Office, Department of Internal Audit, and the Department of Finance; and WHEREAS, the general public may then be served in a more efficient and satisfactory manner; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1, There is hereby created a department to be known as the Department of Management Services, Section 2, The head of the Department of Management Services shall be known as the Director of Management Services, gedtion 3ti 'The dity.Managef is hereby authori'tech ' topp a ` `Dint tie Diredtoi� of the Depaftment of Managetefit' SerVii es who shall administer the affairs of this, departtefit. subject to the supervision and doiitrol of, the City.'Manager ifi ail tatters. gectiof 4, 8 bjedt to the supervision aricl dontrol - of the City Manager, the Director of,the Department'of Manage". g ment Services . shall manage, supervise,: control and administer. the affairs of the Department. The Department shallprovide operations analysis services, budget management services, computer assistance development services, internal audit services and such other similar services as the City Manager may direct. .Section.5. There shall be 'included in the Department of Management Services, an Operations Analysis, Section, Budget, Management Section, Computer Systems Development Section,and an. Internal Audit Section.Each section shall be headed by an 'Assistant Department Head. Section 6. Subject to the supervision and control of the Department of Management Services, the Assistant Director of the Department of Management Services in charge of the Operations Analysis Section, shall provide program analysis, method improvement studies and performance measurement, using basic analytic and industrial engineering techniques in order to improve the effectiveness and efficiency of management and operations; shall conduct a management analyst intern program and shall perform such other duties and functions as may be specified by the Department Director. Section is Subject to the supervisioh and control of the Director of the Department of Matiagetnent SerVides, the Asaistatit Department Diredtor ih charge of budget tahagettleft services shall prottide the services of a Midget office, which shall .include formulating, coordinating and eValuatitig of the City budget, reporting on perfof`mance and resource allocation artd shall perform such allied duties and functions as the Department Director may specify. Section 8. Subject to the supervision and control of the Director of the Department of Management Services,. the Assistant Department Director in charge of computer systems development services shall conduct and coordinate all City com- puter systemsdevelopment activities, including the acquisition and utilization of hardware and the development ofcomputer systems for City operations, and shall perform such allied duties and functions as the Department Director may specify. Section 9. Subject to the supervision and control of the Director of the Department of Management Services, the Assistant Department Director in charge of Internal Audit Services shall manage, supervise, control the internal audit functions to be performed in behalf of the City of Miami. He shall establish within the section a subordinate division to be known as the Public Utility Division. The Public Utility Division shall maintain such records as are necessary to establish. whether the various utilities including the Metropolitan Depart- ment of Water and Sewers, operating in the City, are complying with the provisions of the applicable laws and ordinances and shall submit to the City Commission semi-annual reports reflect- ing the activities of the utility companies, including but not limited to operating expenses, gross income, profitand loss depreciation schedules and other pertinent' information, Such reports shall be numbered ddhseddtiVelY becjifihihl With the f eht hi1thber folloWing the number of the last 'report .tendered by the Public ttiiity biVision of the Bureau of lfiterfial Auditors-1 tack even nlufmbered report shall be aecoMpanied by an annual audit of each of the Utilities included in each semi-annual report and shall be such observations arid recommendations as the Bureau of Internal Auditors may elect to make in the public interest. Section 10. It is declared to be the leg islatiVe intent of this body that if any section, subsection, sentence, phrase, or provision of this ordinance is held invalid, the remainder of .the ordinance shall not be affected. Section 11. All ordinances, or: portions of the city Code or parts of ordinances which are in conflict with this ordinance are hereby amended or repealed, as appropriate,insofar as there is conflict. Section 12. The duties and functions herein prescribed previously performed by other elements of the City Administration shall continue to be performed by the appropriate section estab- lished herein. All records, files and documents of any nature appertaining thereto transferred to the appropriate section shall be assimilated into the files and records of the new section as may be appropriate.
