JoL .i.li INTERIM ZONING biSTRICT Pbi A PERIOD OP SIX MONTHS FROM ITS ?RESENT EXPIRATION bATE; REPEAL- INO ALL ORDINANCES IN CONFLICT; CONTAMNING A, SEVERABILITY PROVISION; DECLARING THIS ORDINANCE TO 88 AN EMERGENCY MEASURE; DISPENSING WITH THE REQUIREMENT OP READING THE SAME ON TWO SEPARATE DAYS BY A VOTE OP NOT LESS THAN POUR PIPTHS OP THE MEMBERS OP THE COMMISSION 12 WHEREAS, Ordinance No. 8212 passed and adopted on 13 December 13i 1973# authorized the creation of the Dr. Martin 14 Luther Icing Boulevard Interim Zoning District; and 15 WHEREAS, the Dr. Martin Luther King Boulevard Interim 16 17 18 19 20 21 23 24 25 Zoning District was to be effective for a period of one year from its date of adoption; and WHEREAS, a six month extension of the time limits is 'necessary to allow for.the completion of development plans and guidelines to provide a basis for the preparation of specific rezoning recommendations; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF: THE CITY OF MIAMI, FLORIDA: Section 1. That Ordinance No. 8212, establishing' a Dr. Martin Luther King Interim Zoning District is hereby 26 extended for a period of six months beginning December 13, 1974 27 and ending June 12, 1975. 28 Section 2. All ordinances, code sections or parts 29 thereof in conflict herewith, insofar as they are in conflict 30 31 32. 33 34 are hereby repealed, 4, 6 7 8 9 10 11 12 13 valid as if such parts had, not been included therein. 14 Section 1. if of y sectioh, tent -eh -eel chute, phrase, or word -of this.ordinahce is for any reason held or'declared to . be uhcohstitutlonal, .inoperative of, Void, 'such holdifiq or .inValidity shall.not affect the.remaihing portions of this, ordinance; and it shall be; construedto have been the ihteht of the Commission of .the City. of Miami to pass ,this ordinance ,without such unconstitutional, invalid, or inoperative part therein; and the remainder of this ordinance, after the exclusion of such part or'parts'shall'be deemed and held to be Section 4. This ordinance is hereby. declared to 15 be an emergency measure on the'ground of urgent public need for 16 the preservation of peace, health, safety.and property.in the. 17 City of Miami., 18 Section 5. Article IV Section 39 (41)`of `the: Comprehensive 'Zoning Ordinance. The Dr, Martin Luther King Boulevard Interim 'Zoning District was estab- lished by Ordinance 8212 on Dccernber 13, 1974. "The purpose of the district is to provide' land use. controls to insure that the planning efforts -now under- way will not be. nullified„by new, development that is'not'in accord with the plans.' During the past year considerable progress has been achieved towards the completion of the 'Boulevard planning. A brief synopsis of the status of the .projects are listed below. 1. The M1.K Linear Open Space' Plan as prepared by the Dr. Martin Luther King Development Corporation and M.- Paul Friedberg and Associates was completed and approved in principle by_ the City- Commission. 2. Preliminary plans for African Square Park located between 1 4l.11 and 15th, Avenue along the Boulevard were approved in principle by the Commission. The administration. is. now negotiating with landscape architectural consultants for this project. 3. Acquisition of those parcels required for Aft•ican Square has been initiated. }, . The 1)acle CoLmtyr Public Works Department will begin acqui- • 'sition of these parcels required for the Boulevard right-of-way' within the next fewmonths. Additionally, negotiations with engineering consultants have been initiated by Dade.
