RESOLUTION Me. 74-1332_
A RESOLUTION AUTHORIZING AND DIRECTING THE
CITY MANAGER AND THE CITY CLERK TO ENTER
INTO ANLEASE AGREEMENT WITH LYMAN W. HIGGS,
en. P'OR THE LEASE OF THE WEST 25 FEET OF LOT
20, ST. JOHNS PARK, RECORDED IN PLAT BOOK 5,
AT PAGE 11, OL'' THE PUBLIC RECORDS OF DADE
COUNTY, FLORIDA.
WHEREAS, the City of Miami owns a sewer easement on the
West 25 feet of Lot 20, St. Johns Park; and
WHEREAS, this easement has been leased to the owner of
the Linnay Apartments for use as off-street parking; and
WHEREAS, the Linnay Apartments have been sold to their
present owner, Mr. Lyman W. Higgs, Jr.; and
WHEREAS, the new owner desires to re -lease the easement;
and
'WHEREAS, the previous agreement between the City of Miami
and the previous owner did not permit the assignment of the
rights to this easement;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA;
1. Section 1. That the City Manager and the City Clerk
be authorized and directed to enter into a lease agreement with
Lyman W. Higgs, Jr., for the use of the West 25 feet of Lot 20,
St. Johns Park, for the purpose of
