RESOLUTION NO. 74-1315
A RESOLUTION GRANTING PERMISSION, AS PROVIDED
IN ORDINANCE NO. 6871, ARTICLE IV, SECTION 36(1),
FOR THE ENCLOSURE OF THE FIRST FLOOR AREA AT
3801 BISCAYNE BOULEVARD WITH A SIDE STREET SET-
BACK OF 2.4'; AND LOT 46 TO BE DEVELOPED AS A
PARKING LOT IN CONJUNCTION WITH THE SAID STRUCTURE,
SUBJECT TO SAID BUILDING BEING USED FOR GOVERNMEN-
TAL USE ONLY AND PLANNING DEPARTMENT APPROVAL OF
DEVELOPMENT AND LANDSCAPE PLANS ON LOTS 40 THRU
46, MAGNOLIA PARK (5-25); ZONED C-1 (LOCAL
COMMERCIAL) AND R-3 (LOW DENSITY MULTIPLE DISTRICTS.
WHEREAS, the Miami Planning Advisory Board at its
meeting of November 6, 1974, Item #2, following an advertised
Hearing, adopted Resolution No. PAB 47-74 by a 7 to 0 vote
recommending approval as per Ordinance No. 6871, Article IV,
Section 36(1), for permission as hereinafter set forth; and
WHEREAS, this Commission deems it advisable in the
interest of the general welfare of the City of Miami to grant this
permission requested on the ground that a refusal would result
in practical difficulties and unnecessary hardship to the
applicant under a C-1 (Local Commercial) and R-3 (Low Density
Multiple) Districts;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. That the application for permission, as
provided in Ordinance No. 6871, Article IV, Section 36(1), for
the enclosure of the first floor area at 3801 Biscayne Boulevard
with a side street setback of 2.4'; and Lot 46 to be developed
as a parking lot in conjunction with said structure subject to
said building being used for Governmental Use only and Planning
Department approval of development and landscape plans on Lots 40
thru 46, MAGNOLIA PARK (5-25) zoned C-1 (Local Commercial) and

P-.3 (tow Density Multiple) Districts, be and the same is
hereby granted.
