HomeMy WebLinkAboutR-74-1299RESOLUTION NO. 74-1299 A RESOLUTION TO CERTIFY AND DECLARE THE RESULTS OF THE SPECIAL BOND ELECTION HELD NOVEMBER 5, 1974 BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The returns of the special bond election held on November 5, 1974 having been received from the elec- tion officials of each of the voting precincts within the City of Miami and the Commission having canvassed such re- turns declares: (a) Said election was duly and properly held and notice thereof was duly given in accordance with law and Ordinance No. 8315, passed and adopted October 10, 1974, and entitled: AN ORDINANCE AUTHORIZING THE ISSUANCE OF AN AMOUNT NOT EXCEEDING $12,000,000.00 OF PUBLIC ISLAND PARK AND RECREATIONAL FACILITY BONDS OF THE CITY OF MIAMI FOR THE PURPOSE OF PAYING THE COST OF ACQUIRING, CONSTRUCTING AND DEVELOPING A PUBLIC ISLAND PARK AND RECREATIONAL FACILITY IN THE CITY OF MIAMI; PROVID- ING FOR BONDS OF $5,000, EACH BEARING INTEREST NOT EXCEEDING VI% PER ANNUM; PROVIDING FOR A SPECIAL TAX; PROVIDING FOR SUBMISSION TO'ELECTORS AT THE NOVEMBER 5, 1974 ELECTION; REQUESTING TO BE PLACED ON THE BALLOT BY SUPERVISOR OF ELECTIONS; PROVIDING FOR NOTICE BY PUBLICATION; CONTAINING A SEVERABILITY CLAUSE; PROVIDING;THAT THIS ORDINANCE SHALL BE EF- FECTIVE IMMEDIATELY UPON ITS PASSAGE AND DISPENSING WITH THE REQUIREMENT OF READING THIS ORDINANCE ON TWO SEPERATE DAYS BY A VOTE OF NOT LESS THAN FOUR - FIFTHS OF THE COMMISSION That all steps in connection with and leading up to said special bond election were duly, regularly and lawfully taken and had; and all applicable provisions of the Constitution and Statutes of the State of Florida and of said ordinance have been fully complied with. "DOCUMENT INDEX ITEM N0. " (b) The inspectors and clerks of each election pre- cinct in the City have made returns to the Commission of the results of the election in each such precinct on the question submitted at said election. (c) At said election there was submitted to the qual- ified electors of the City of Miami, Florida the following question: "Shall bonds of the City of Miami, Florida, in an amount not exceeding $12,000,000.00 be issued under the provisions of Ordinance No. 8315 for the purpose of providing funds to pay the cost of acquiring, constructing and developing an Island Park and Recreational Facility in the City of Miami; said bonds to be issued at one time or from time to time with the maturity dates established by resolution of the City Commission, bearing in- terest not exceeding seven and one-half per cent (71%) per annum and payable from unlimited ad valorem taxes?" (d) Each qualified elector of the City of Miami was given the opportunity of voting for or against the issuance of said bonds. Section 2. It is hereby found, determined and declared that /0/ q,s-6 votes were cast by qualified electors in favor of the issuance of said bonds, and / $'77 votes were cast by qualified electors against the issuance of said bonds, and the Commission hereby declares and certifies that the issuance of said $12,000,000,00 of Public Island Park and Recreational Facility Bonds of the City of Miami was w4approved by the qualified electors of the City of Miami at said Special Bond Election. That the total number of ballots cast at said Special Bond Election in the 86 voting precincts was s/i 76 O• Section 3. That the City Clerk be, and he is, hereby authorized and directed to perform any and all incidental duties in connection herewith as required by law. PASSED AND ADOPTED this 21 day of November, 1974.
