A RESOLUTION TO CERTIFY AND DECLARE THE RESULTS OF THE
SPECIAL CHARTER AMENDMENT ELECTION HELD ON NOVEMBER 5,
1974 FOR THE PURPOSE OF VOTING FOR THE RATIFICATION OR
REJECTION SEVERALLY OF THE FOLLOWING QUESTIONS, TO WIT:
(1) "SHALL SECTION 62 OF THE CITY OF MIAMI CHARTER BE
AMENDED FOR THE PURPOSE OF PROVIDING FOR THE ADDITION
OF THE CHIEF OF FIRE RESCUE IN THE UNCLASSIFIED SER-
VICE OF THE CITY BY ADDING THE PHRASE 'CHIEF OF FIRE
RESCUE' IN SUB -SECTION (c) (1) IMMEDIATELY AFTER THE
'DIRECTOR OF TRAINING IN THE FIRE DIVISION'?" (2) "SHALL
SECTION 56 (J) (4) (h) OF THE CHARTER BE AMENDED TO PRO-
VIDE THAT ONLY (a) THREE QUARTERS OF THE COST OF SANI-
TARY SEWER BE APPORTIONED TO ABUTTING PROPERTY EXCEPT
AT INTERSECTIONS OR (b) THREE QUARTERS OF THE COST OF
AN EIGHT -INCH SANITARY SEWER EXCEPT AT INTERSECTIONS AS
SUCH COST, ESTIMATED BY THE CITY MANAGER (WHICHEVER BE
THE LESSER) NOT INCLUDING HEREIN THE COST OF LATERALS,
PUMPING STATION OR OUTLET BE APPROVED OR DISAPPROVED?"
(3) "SHALL SECTIONS 19 AND 62 OF THE CITY OF MIAMI
CHARTER BE AMENDED FOR THE PURPOSE OF PROVIDING FOR THE
CREATION OF THE OFFICE OF DEPUTY CITY MANAGER WHO SHALL
ACT FOR AND IN THE NAME OF THE CITY MANAGER AND WHOSE
ACTS SHALL BE AS VALID AS THOUGH PERFORMED BY THE CITY
MANAGER IN PERSON AND THE ADDITION OF THE POSITION OF
DEPUTY CITY MANAGER TO THE LIST OF POSITIONS IN THE UN-
CLASSIFIED SERVICE OF THE CITY OF MIAMI?" (4) "SHALL
SECTION 13-A OF THE CITY OF MIAMI CHARTER BE AMENDED FOR
THE PURPOSE OF PROVIDING THAT IF A VACANCY OCCURS ON THE
COMMISSION SUCH VACANCY SHALL ONLY BE FILLED BY AN AP-
POINTMENT FOR A PERIOD OF TIME TERMINATING AT SUCH TIME
SUCH VACANCY IS FILLED AS THE RESULT OF AN ELECTION HELD
AT EITHER (1) THE ODD YEAR CITY OF MIAMI GENERAL ELECTION
AT WHICH ELECTION THE MAYOR AND TWO COMMISSIONERS ARE
ELECTED, OR (2) THE EVEN YEAR, STATE OF FLORIDA GENERAL
ELECTION AT WHICH ELECTION NATIONAL, STATE AND COUNTY
OFFICES ARE FILLED; WHICHEVER IS HELD FIRST?" (5) "SHALL
SECTION 58 (b) OF THE CHARTER OF THE CITY OF MIAMI BE
AMENDED FOR THE PURPOSE OF CONSOLIDATING VOTED BOND ISSUES
INTO A SINGLE ISSUE WITH THE APPROVAL OF THE CITY COMMIS-
SION,DELETING THE REQUIREMENT FOR PAYMENT IN GOLD COIN AND
SUBSTITUTING PAYMENT IN LEGAL TENDER OF THE UNITED STATES
IN LIEU THEREOF?"
WHEREAS, by Ordinances numbered 8384, 8285, 8288, 8287,
and 8289, passed and adopted_=_July 11, 1974, the Commission
of the City of Miami, Florida, called and provided for a
special municipal election to be held in said city on November
5, 1974, for the purpose of submitting to the duly registered

or rejection of the following questions, to -wit:
Shall Section 62 of the CiLy of Miami Charter
be amended for the purpose of providing for
the addition of the Chief of Fire Rescue in
the unciassiped service of the City by
adding the phrase "Chief of Fire Rescue" in
sub -section (c) (1) immediately after the
"Director of training in the fire division?"
Shall Section 56 (J) (4)hof the Charter
'be amended to provide that only (a) three
quarters ofthe cost of sanitary sewer
be apportioned to abutting property except at
intersections.or (o.) three quarters of the
cost of an eight -inch sanitary sewer except
at intersections as such cost, estimated by
the City Manager (whichever be the lesser)
not including herein the cost of laterals,
pumping station or outlet be approved or
disapproved?.
Shall Sections 19 and 62 of the City of Miami
Charter be amended for the purpose of providing
for the creation of the office of Deputy City
Manager who shall act for and in the name of
the City Manager and whose acts shall be as
valid as though performed by the City Manager
in person and the addition of the position of
Deputy City Manager to the list of positions
in the unclassified service of the City of
Miami?
Shall Section 13-A of the City of Miami
Charter be amended for the purpose of
providing that if a vacancy occurs or
the Co t. ission such vacancy shall only
be filled by an appointment for. a period

WHEREAS, the inspectors and clerks of each precinct in
the City have made returns to the Commission of the results of
the election in each such precinct on each of the questions
submitted at said election, and the returns of said election
have been delivered and canvassed by the Commission;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. That the Commission finds and hereby ratifies
and declares the results of the special municipal election
held November 5, 1974, to be as follows:
That on the question proposed on the ballots:

Commission declares and certifies that said question was
approved by the electorate.
That the total number of ballots cast at said election
in the 86 voting precincts was 3 76 0
Section 2. That the City Clerk be, and he is, hereby
authorized and directed to perform any and all incidental
duties in connection herewith as required by law.
Section 3. Said election was duly and properly held and
notice thereof was duly given in accordance with law. All steps
in connection with and leading up to said special election were
duly, regularly and lawfully taken and had; and all applicable
provisions of the Constitution and Statutes of the State of
Florida and of said ordinances have been complied with.
PASSED AND ADOPTED this 21 day of November, 1974.
