A RESOLUTION DESIGNATING THE SIEGENDORF BICYCLE
PATH A RECREATION AREA FOR USE BY THE GENERAL
PUBLIC; AUTHORIZING AND DIRECTING THE CITY MANAGER
TO =mit AND RECORD IN THE OFFICE OF THE COUNTY
CLERK A RIGHT OF WAY DEED CONVEYING THE USE OF THE
SIEGENDORF BICYCLE PATH FOR RECREATIONAL PURPOSES
ONLY, SAID DEED BEING A REQUIREMENT OF THE FLORIDA
RECREATION DEVELOPMENT ASSISTANCE PROGRAM, THE
PROGRAM UNDER WHICH FUNDS FOR CONSTRUCTION OF SAID
BICYCLE PATH SHALL BE PROVIDED.
WHEREAS, on January 19, 1973, the State of Florida
approved bicycle path funding for the Siegendorf Bicycle Path,
also known as the Wainwright-Rickenbacker Bicycle Path, extending
from Main Highway at Franklin Avenue to the Rickenbacker Causeway
entrance, said grant being in the amount of $23,645; and
WHEREAS, Resolution No. 73-598, adopted July 26, 1973,
directed the City Manager to enter into a Contract and Agreement
with the State of Florida for the construction of the Siegendorf
Bicycle Path and allocated $26,482 from the Capital Improvement
Fund - Unallocated Funds account; and
WHEREAS, on July 9, 1974, a Contract and Agreement
between the State of Florida and the City of Miami, duly executed
by the City Manager, was sent to the State of Florida Department
of Natural Resources, said Contract and Agreement stipulating
that the City shall dedicate the Siegendorf Bicycle Path a
recreation area in perpetuity to be offered to the general public
for recreational purposes only; and
WHEREAS, in order to abide by the requirements of the
Contract and Agreement, it is necessary for the City to execute a
Right of Way Deed conveying the Siegendorf Bicycle Path for

recreational purposes only in perpetuity to the general public,
and said document has been approved by the Department of Law;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The SIEGENDORF BICYCLE PATH, also known as
the Wainwright-Rickenbacker Bicycle Path, be, and the same is
hereby designated, a recreation area in perpetuity to be offered
to the general public for recreational purposes only.
Section 2. The City Manager be, and he is hereby,
authorized and directed to execute a RIGHT OF WAY DEED, conveying
the SIEGENDORF BICYCLE PATH for recreational purposes only in
perpetuity unto THE PUBLIC, and said DEED shall be recorded in the
Office of the County Clerk.
