A RESOLUTION ACCEPTING THE PLAT ENTITLED
BAY CLUB SUBDIVISION, A SUBDIVISION IN THE
CITY OF MIAMI, FLORIDA, AND ACCEPTING THE
DEDICATIONS SHOWN ON SAID PLAT AND AUTHOR -
/ZING AND DIRECTING THE CITY MANAGER AND
CITY CLERK TO EXECUTE THE PLAT.
WHEREAS, on April 20, 1972, the City Commission
passed and adopted Resolution No. 72-110 granting permission
to Brickell Bay Club for the construction of a temporary model
apartment within a portion of the undeveloped right of way
reserved for access street purposes paralleling Brickell Avenue;
and
WHEREAS, on June 5, 1972 the Miami Planning Board
adopted Resolution No. 72-152 approving the plat;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. The Plat entitled BAY CLUB SUBDIVISION
being a replat of Lots 70, 71, 72 and 73, Block "B" of FLAGLER
SUBDIVISION, Plat Book 5, Page 44, together with lands lying
southeasterly thereof to the Dade County Bulkhead line all
being in Sections 39 and 40, Township 54 South, Range 41 East,
City of Miami, Dade County, Florida, which by reference is made
a part hereof as if fully incorporated herein and the dedications
as shown thereon together with all existing and future planting,
trees and shrubbery on said property, to the perpetual use of
the public, be and the same are, hereby accepted and confirmed
by the City of Miami, Florida.

Section 2. Except for the construction of those
improvements provided for in the agreements entered into
between the Owner and the Director of the Department of
Public Works on behalf of the City of Miami, Florida, dated
February 15, 1974 and July 24, 1974, the requirements of
Chapter 54, Section 54-20, Code of the City of Miami, Florida
and State law as to improvements to be made in subdivisions
will hereby expressly be waived.
Section 3. Of all other requirements of State Law
concerning the posting of a Performance Bond for the construc-
tion of improvements, that portion pertaining to the main-
tenance of said improvements is hereby expressly waived.
Section 4. The requirements of State law concern-
ing the showing of grades of rights of way on the Plat are
hereby expressly waived.
Section 5. The City Manager and the City Clerk,
both of the City of Miami, Florida, are hereby authorized and
directed to execute the Plat.
