HomeMy WebLinkAboutR-74-0691MEA/rr 7/25/74 RESOLUTION NO. 704 9/ A RESOLUTION OF THE COMMISSION OF THE CITY OF MIAMI AUTHORIZING AND DIRECT- ING THE PROPER G'FFICIALS TO ALLOCATE $77,500 FROM THE 1972 PARK AND RECREA- TIONAL FACILITIES BOND FUNDS, AND TO PAY SAID SUM TO JOHN WATSON, III, ESQUIRE, ATTORNEY FOR COCONUT GROVE MARINE PROPERTIES, INC., CIVIL ACTION NUMBER 73-15433; AND FURTHER DIRECTING THE CITY ATTORNEY TO DISMISS THE APPEAL IN SAID CASE UPON THE EXECUTION OF SATISFACTORY LEGAL INSTRUMENTS. WHEREAS, the City of Miami, as condemnor, is required to pay the attorney's fees of a condemnee; and WHEREAS, the City condemned certain properties owned by Coconut Grove Marine Properties, Inc.; and WHEREAS, the court has awarded the payment of $87,500 to JOHN WATSON, III, Esquire, Attorney for Coconut Grove Marine Properties, Inc.; and WHEREAS, the City has taken an appeal from the court's order; and WHEREAS, the City Attorney recommends settlement in the amount of $77,500; and WHEREAS, Mr. Watson has agreed to accept the said amount in full payment of all attorney's fees due and in lieu of the court order; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 1TE.M NO. CITY COMMISSION MEETING OF JUL4 '1974 RESOLUTION tIO. ,1..57./1 - REMARKS: Section 1. The proper officials of the City of Miami are hereby authorized and directed to allocate $77,500 from the 1972 Park and Recreational Facilities Bond Funds to pay said sum to John Watson, III, Esquire, Attorney for Coconut Grove Marine Properties, Inc., Civil Action Number 73-15433. Section 2. The City Attorney is directed to dismiss the appeal in said case upon the execution of satisfactory legal instruments. PASSED AND ADOPTED this"day of , 1974.
