RESOLUTION NO. 401:"'
A RESOLUTION PROVIDING THAT IN THE AREA
ENCOMPASSED BY THE PLANNING STUDY FOR
COCONUT GROVE, NO BUILDING PERMITS FOR
NEW CONSTRUCTION SHALL BE ISSUED WITHOUT
PRIOR APPROVAL OF THE CITY COMMISSION
EXCEPT FOR THOSE AREAS IN THE R-1 AND R-2
ZONING DISTRICTS FOR WHICH NO CHANGES HAVE
BEEN DESIGNATED IN SAID STUDY; SAID PRO-
VISIONS SHALL BE IN EFFECT UNTIL THE EF-
FECTIVE DATE OF ZONING ORDINANCES ENACTED
IN ACCORDANCE WITH THE COCONUT GROVE AREA
STUDY AS FINALLY ADOPTED BY THE CITY
COMMISSION.
WHEREAS, a great number of requests for building
permits may be made by citizens wishing to take advantage
of the existing zoning regulations prior to the enactment
of ordinances in accordance with the comprehensive area
study for Coconut Grove; and
WHEREAS, the Commission finds that the issuance of
permits, under the existing regulations, may be to the detri-
ment of the citizens of the City of Miami; and
WHEREAS, the Commission finds it desirable to avoid
the detrimental effect of permitting the construction of build-
ings that would not be in accordance with the regulations that
will be enacted in accordance with the area study when it is
finally adopted; and
WHEREAS, the Commission finds that a large amount
of the Coconut Grove area is comprised of R-1 and R-2 zoning
districts for which no changes have been designated; and
WHEREAS, the Commission finds that the best method
of protecting the general citizenry of Miami and individuals
seeking to obtain building permits will be to treat each
application for a building permit individually;

REMARKS:
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. No building permits for new construction
shall be issued in the area encompassed by the Planning Study
for Coconut Grove without the prior approval of the City Com-
mission except for those areas in the R-1 and R-2 zoning
districts for which no changes have been designated in said
Study.
Section 2. The provisions of Section 1 hereof
shall be in effect until the effective date of zoning ordin-
ances enacted in accordance with the Coconut Grove area
study as finally adopted by the City Commission.
