A RESOLUTION ACCEPTING THE JULY 23, 1974 COVENANT TO RUN WITH THE LAND FROM THE AMERICAN BANKERS LIFE ASSURANCE COMPANY OF FLORIDA, RELATING TO THE INSTALLATION OF AN ELECTRICAL CONDUIT SYSTEM ACROSS THE PUBLIC RIGHT OF WAY, A COPY OF SAID COVENANT IS ATTACHED HERETO AND MADE A PART HEREOF; AND DIRECTING THE PROPERTY MANAGER OF THE CITY OF MIAMI TO RECORD SAID COVENANT IN THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA WHEREAS, the American Bankers Life Assurance Company of Florida is the owner of a bank and office building at 600 Brickell Avenue, and has requested the City to issue a permit to construct, install, operate and maintain conduits for electric power cables through, across, along and under the surface of the public right of way at S.E. 7th Street, west of Brickell Avenue, thereby con- necting the existing electrical system operating from the build- ing at 600 Brickell Avenue to another commercial building located at 700 Brickell Avenue, leased by American Bankers Life Assurance Company of Florida where it has expanded its business operations; and WHEREAS, the American Bankers Life Assurance Company of Florida has executed and delivered to the City a Covenant To Run With The Land containing the usual guarantees and protection for the City of Miami; and WHEREAS, the Department of Public Works has investigated the request and recommends the issuance of the permit for the underground construction; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: << C12.1"ar—•,,T V;Isrii%E.X CITY COMMISSION MEETING OF JULA41974 RESOLUTION NU..'; Cp fro REMARKS: Section 1. That the July 23, 1974 Covenant To Run With The Land from the American hankers Life Assurance Company of Florida, relating to underground construction through, across, along and under the surface of the public right of way be, and the same is, hereby accepted. Section 2. That the proper officials of the City of Miami be, and they are hereby authorized to issue the necessary permits for the underground construction referred to in said Covenant, a copy of said Covenant is attached hereto and made a part hereof. Section 3. That the Property Manager of the City of Miami be, and he is hereby directed to record the aforesaid Covenant in the Public Records of Dade County, Florida.
