HomeMy WebLinkAboutR-74-0649ESOLUTION NO. 44, >: A RESOLUTION EXPRESSING THE INTENT OF THE CITY COMMISSION OF THE CITY OF MIAMI TO CONVEY TO METROPOLITAN DADE COUNTY BY QUIT CLAIM DEED, LAND AT THE 20TH STREET PROP- ERTIES WEST OF N.W. 12TH AVENUE OWNED BY THE CITY FOR THE CONSTRUCTION OF A SOLID WASTE TRANSFER STATION BY DADE COUNTY; SAID DEED TO CONTAIN A REVERTER CLAUSE; AND AUTHORIZING AND DIRECTING THE CITY ATTORNEY TO DRAFT A QUIT CLAIM DEED CONVEYING SAID PROPERTY TO • THE COUNTY AFTER HAVING DETERMINED THAT SUCH COVERTERS MAY LEGALLY BE MADE. • WHEREAS,Dade County requires land at the City's 20th Street properties west of N. W. 12th Avenue, now occupied by the City's auto pound, for the cdnstruction of a solid waste transfer station; and WHEREAS,.,a quit claim deed is required for conveying such property to Metropolitan Dade County, to contain reversion clauses to the effect that ownership of theproperty would revert to the City in the event the County fails to construct a transfer station within 5 years or if the property is not used for the purpose for which it is being conveyed; and WHEREAS, Dade County will obtain an architectural consultant who will make studies to ascertain the minimum amount of land required= and the acreage of property to be conveyed; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The intent of theCity Commission of the City of Miami to convey to Metropolitan Dade County by Quit Claim Deed, land at the 20th Street properties west of N. W. 12th Avenue owned by the City of Miami is hereby expressed. Section 2. The City Attorney is hereby authorized and directed to prepare a Quit Claim Dead with the above specified conditions afterhaving determined that the City of Miami may legally transfer' such property.
