AN ORDINANCE DISCONTINUING THE DEPARTMENT
OF YACHT DOCKS; CREATING A NEW MPA T 4Ei`IT
TO BE KNOWN AS 'TIE DEPARTMENT OF PUBLIC
FACILITIES; PROVIDING FOR TFIE APPOINTMENT
OF A DIRECTOR OF SAID NEW DEPARTMENT L'Y
THE CITY MANAGER; PROVIDING FOR THE INCLUSION
OF PRESENT AND FUTURE PUBBLIC FACILITIES IN
TEMF NEW DEPARTMENT; PROVIDING FOR THE OPERATION
OF SAID DEPARTMENT AND PRESCRIBING TIIE FUNCTIONS
AND DUTIES TIiEREOF; PROVIDING FOR A SEVERABILITY
CLAUSE; REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT THEREWITH.
WHEREAS, Section 19A of the Charter of the City of Miami
provides that the Commission may create new departments or dis-
continue any department and determine, combine, and distribute
the functions and duties of departments and subdivisions thereof;
and
WHEREAS, it is the desire of the Commission to exercise
such authority and to create a new department to be known as the
Department of Public Facilities, and to distribute and transfer
to it certain functions and duties heretofore performed by the
Department of Yacht Docks, the Department of Parks and Recreation,
and the Department of Publicity and Tourism; and
WHEREAS, the general public may then be served in a more
efficient and satisfactory manner;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. That there is hereby created and established
as an agency and instrumentality of the City of Miami, a new depart-
ment to be named and known as the Department of Public Facilities.
Section 2. 'that the present Department of Yacht Docks
is hereby discontinued and its previously budgeted personnel,
records, equipment, and the functions and duties thereof are in-
corporated into the said new department of Public Facilities.
Section 3. That the functions and duties of the following
public facilities, together with their previously budgeted personnel,
records, and equipment are also hereby placed in, and administered
by this new Department:
a. Miamarina, Dinner Key marina, and any future marine
activity.
b. Orange Bowl Stadium.
c. Miami Stadium.
d. Marine Stadium.
e. Dinner Key Auditorium.
Section 4. That the City Manager is hereby authorized
to additionally transfer the budgeted personnel, records, equipment,
and the functions and duties, in their entirety, of other such
:similar public facilities which appropriately should be administered
by this new Department, at such time as this best serves the interest
of the City, in his judgement.
Section 5. That the City Manager is hereby authorized
to appoint a Director of the Department of Public Facilities who
shall administer the affairs of this Department, subject to the
supervision and control of the City Manager in all matters.
Section 6. That the Head of the Department of Public
Facilities shall be known as the Director of Public Facilities.
Section 7. That it is declared to be the legislative
intent of this body that if any section, subsection, sentence,
phrase, or provision of this ordinance is held invalid, the
remainder of the ordinance shall not be affected.
Section B. That all ordinances or portions of the City
Code or parts of Ordinances which are in conflict with this Ordinance

are hereby amended or repealed, as appropriate, insofar as there
is conflict and, where appropriate, the words Director of Public
Facilities shall be subsl:ituted for the words Director of the
Department of Yacht Dock;; wherever they appear.
Section 9. That all previously adopted Ordinances,
Resolutions, Laws, Rules, and Regulations prescribing functions
and duties of entities transferred herein, shall remain in full
force and effect as if said entities had been under the Department
of Public Facilities as the time of such adoption.
