RESOLUTION NO. 11 47
A RESOLUTION ACCEPTING THE RIGHT OF WAY
DEED EXECUTED BY A. M. WAYNE AND E. L. FREDERICS
CONVEYING FOR HIGHWAY WIDENING,STRIPS OF
LAND ALONG MARY STREET AND TRADE AVENUE,
AND DIRECTING THE PROPER OFFICIAL OF THE
CITY OF MIAMI TO RECORD SAID DEED IN THE
PUBLIC RECORDS OF DADE COUNTY.
WHEREAS, 5.5-foot and 10-foot strips of land are
needed, respectively, along the easterly side of Mary Street
and the southerly side of Trade Avenue to bring said street
and avenue to their fully zoned widths; and
WHEREAS, A. M. Wayne and E. L. Frederics, the owners,
have executed and delivered to the City of Miami a Highway
Right of Way Deed for the required land; and
WHEREAS, it is now in order for the City Commission
to accept the aforesaid Highway Right of Way Deed and to have
it recorded in the Public Records of Dade County;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. That the April 24, 1974, Highway Right
of Way Deed from A. M. Wayne and E. L. Frederics for dedication
of strips of land along the easterly side of Mary Street and
along the southerly side of Trade Avenue be, and the same
is, hereby accepted.,
Section 2. That the proper official of the City of
Miami be, and he is hereby, authorized and directed, to record
the aforesaid Highway Right of Way Deed in the Public Records
of Dade County.
PASSED AND ADOPTED this 10day of L , 1974.

WITNESSETH, That the said part les o/ the first part, for and in consideration of the sem of
One. (51.00) Dollar and otber good and valuable considerations to them
in band paid by the party of the second part. the receipt whereof is hereby
acknowledged, have granted, bargained and sold to the said party o/ the second part, its successors
and assigns, forever, tbe following described land. situate, lying and being in tbe County of Dade and State
of Florida, to -wit:
The North 10 feet and the West 5.5 feet of Lot 26, and the
North 10 feet of Lot 27, both Lots 26 and. 27 being of CHARLES
M. MUNDY'S SUBDIVISION, according to the plat thereof, re-
corded in Plat Book 3 at Page 15, of the public Records of
Dade County, Florida.
IT IS UNDERSTOOD AND AGREED by the parties hereto, tbat the land conveyed is to be used /or
street mad/or sidew ib'parposes only, and in the event that said land conveyed shrill be abewdowad and/or
discontheed by law for said street and/or sidewalk psrposes, the title to said land strati revert to the
said part ies of the first part, their beirs or assigns..
And the said part les of the first part do hereby fully warrant title to said land, and will defend
