2 3 6 7 g 9 10 11 12 13 14 15 16 17 16 19 20 21 22 23 24 25 5/30/74 MEA/ cs RESOLUTION NO. 7 " 1 • A RESOLUTION ACCEPTING THE PLAT ENTITLED LINDSLEY_ALLAPATTAH SUBDIVISION, A SUB- DIVISION IN THE CITY OF MIAMI, FLORIDA; AND ACCEPTING THE DEDICATIONS SHOWN ON SAID PLAT; AND ACCEPTING A COVENANT TO RUN WITH THE LAND POSTPONING THE IMMEDIATE CONSTRUCTION OF ASPHALTIC CONCRETE PAVE- MENT, REMOVAL OF EXISTING SIDEWALK, SIDE- WALK, CURB AND GUTTER, STORM DRAINAGE STRUCTURES, MONOLITHIC CURB AND SIDEWALK, TWO -FOOT WIDE VALLEY GUTTER, AND LANDSCAP- , ING; AND AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY CLERK TO EXECUTE THE PLAT. WHEREAS, the City Planning and Zoning Board and the Department of Public Works have recommended the accep- tance of the plat, entitl INDSLEY-ALLAPATTAH SUBDIVISION; and WHES, on January 10, 1974, the City Commission passed and adopted Resolution No. 74-1 closing for public useiplopportion oft a east -west alley running west from Northwest L5th Ae between Northwest 15th Avenue and Northwest 28th and 29th Streets, said alley lying between the mi le the block and north -south alley, all in accor- nce witTi Tenative Plat No. 895 "LINDSLEY-ALLAPATTAH SUB- DIVISION"; and WHEREAS, it was recommended that the developers of LINDSLEY-ALLAPATTAH SUBDIVISION execute a covenant to run with the land postponing the immediate construction of as- phaltic concrete pavement, removal of existing sidewalk, side- walk, curb and gutter, storm drainage structures, monolithic curb and sidewalk, two -foot wide valley gutter, and land- scaping: "DOCUMENT INDEX ITEM NO -75-0232 Cr,©M CITY I �� JUN 131974 • NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Plat entitled LINDSLEY-ALLAPATTAH SUBDIVISION, being a replat of Lots 6 through 9 and 14 through 26 of RAMICO (P.B. 16, Pg. 74), lying in the Southwest 1/4 of the Southwest 1/4 of the Northwest 1/4 of Section 26, Township 53 South, Range 41 East, City of Miami, Dade County, Florida, which by reference is made a part hereof as if fully incorporated herein and the dedications as shown thereon together with all existing and future plantings, trees and shrubbery on said property, to the perpetual use of the pub- lic be, and the same are, hereby accepted and confirmed by the City of Miami, Florida. Section 2. That exc fo e construction of those improvements provided for in th re tared into between the Owner and the Director of the Department of Pub- Lic Works on behalf of the City of Miami, Florida, dated May 21, 1974, the requirements of Chapter 54, Section 54-20, Code of the City Miami, Florida and State law as to improve- ments to be ade in subdivisions will hereby expressly be waived. The requirements of State law concern- ing the showing of grades of rights -of -way on the Plat are hereby expressly waived.
