A RESOLUTION AUTHORIZING THE CITY
MANAGER TO APPLY TO THE ADMINIS-
TRATOR OF THE ENVIRONMENTAL PRO-
TECTION AGENCY FOR A REIMBURSEMENT
GRANT OF FEDERAL FUNDS TO RECOUP
THE COSTS OF CONSTRUCTION OF THE
GLENROYAL SANITARY SEWER IMPROVE-
MENT SYSTEM, THE SOUTH PINEMOUNT
SANITARY SEWER IMPROVEMENT SYSTEM
AND THE GARDEN SANITARY SEWER IM-
PROVEMENT SYSTEM.
WHEREAS, the City of Miami has made application to
the Environmental Protection Agency for federal grants for
proposed sanitary sewer improvements for the Glenroyal Sanitary
Sewer Improvement System, the South Pinemount Sanitary Sewer
Improvement System and the Garden Sanitary Sewer Improvement
System; and
WHEREAS, Glenroyal, South Pinemount and Garden Sanitary
Sewer Improvements were requested tobbe granted $6,975,000 had
sufficient federal funds been made available; and
WHEREAS, the State of Florida Department of Pollution
Control has given the City of Miami applications for federal grants
for the above -mentioned projects a very low priority, listing more
than 140 projects to be funded first; and
WHEREAS, the City of Miami has committed to be construct-
ed in the 1974-75 Capital Improvements Program the three above -
mentioned sanitary sewer improvements and that waiting for federal
funds would have the effect of stopping the City of Miami's sanitary
sewer Capital Improvement Program; and
WHEREAS, the cost of construction is continuing to spiral
upward and those costs have to be borne by the taxpayers and pro-
perty owners of the City of Miami; and rccoMMi

WHEREAS, the federal regulations provide that when con,-

struction has been initiated by the applicant, no reimbursement
grants will be permitted except under extraordinary conditions;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. That the City Manager is authorized and
hereby directed to request the Administrator of the Environmental
Protection Agency, Russell Train, and the Regional Administrator
of the Environmental Protection Agency, Jack Ravan, to permit
the City of Miami to recover project construction costs and pro-
ject expenses for design, plans and specifications for the Glen -
royal Sanitary Sewer Improvement System, the South Pinemount
Sanitary Sewer Improvement System and the Garden Sanitary Sewer
Improvement System, under a reimbursement grant under these extra-
ordinary circumstances.
