'5'VO A RESOLUTION ACCEPTING THE PLAT ENTITLED BOULEVARD TRACT, A SUBDIVISION IN THE CITY OF MIAMI, FLORIDA; AND ACCEPTING THE DEDI- .CATIONS SHOWN ON SAID PLAT; AND ACCEPTING A COVENANT TO RUN WITH THE LAND POSTPONING THE IMMEDIATE CONSTRUCTION OF A TEN -INCH SANITARY SEWER ON NORTHEAST 14TH STREET ABUTTING THE PROPERTY PLATTED; AND AUTHOR- IZING AND DIRECTING THE CITY MANAGER AND CITY CLERK TO EXECUTE THE PLAT. WHEREAS, the City Planning and Zoning Board and the Department of Public Works have recommended the accep- tance of the Plat. NOW THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Plat entitled BOULEVARD TRACT, being a REPLAT OF LOTS 1 to 5, INCLUSIVE, BLOCK 3, of PERSHING COURT (P.B. 39, P. 6); LOTS 1 to 10, INCLUSIVE, BLOCK 2, OF RICKMERS ADDITION AMENDED (P.B. 3, P. 2) TOGETHER WITH THAT PORTION OF NORTHEAST 2ND COURT LYING NORTH OF THE NORTH RIGHT- OF-WAY LINE OF NORTHEAST 13TH STREET, all in the Southwest 4 of Section 31, Township 53 South, Range 42 East, City of Miami, Dade County, Florida, which by reference is made a part here- of as if fully incorporated herein and the dedications as shown thereon together with all existing and future plantings, trees and shrubbery on said property, to the perpetual use of the pub- lic be, and the same are, hereby accepted and confirmed by the; City of Miami, Florida. Section 2. That except for the construction of those improvements provided for in the Agreement entered into be- tween the Owner and the Director of the Department of Public Works on behalf of the City of Miami, Florida, dated April 8, 35 36 4 3 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 1074, the requirements of Chapter 54, Section 54-20, Code of the City of Miami, Florida and State law as to improvements to be made in subdivisions will hereby expressly be waived. Section 3. The covenant to run with the land exec- uted by W. Sam Smith, as Trustee, and as an individual, join- ed by his wife, Jean Henson Smith; Martha Ann Smith Roberts, joined by her husband, Earle D. Roberts; and Elizabeth Smith Rupp, joined by her husband, William E. Rupp, postponing the immed- iate replacement of approximately 300 feet of existing eight - inch (8") sanitary sewer with ten -inch (10") vitrified clay sanitary sewer together with manholes and other necessary ap- purtenances until such time as required by the Department of Public Works of the City of Miami, Florida be accepted and recorded after the plat has been recorded in the Public Records of Dade County, Florida. Section 4. Of all other requirements of State law concerning the posting of a Performance Bond for the construc- tion of improvements, that portion pertaining to the mainten- ance of said improvements is hereby expressly waived. Section 5. The requirements of State law concern- ing the showing of grades of rights -of -way on the Plat are here- by expressly waived. Section 6. The City Manager and the City Clerk, both of the City of Miami, Florida, are hereby authorized and directed to execute the Plat. PASSED AND ADOPTED this45 day of '/l, 1974.
