HomeMy WebLinkAboutItem #3 - Discussion ItemRES OLUTZ ON NO, A RESOLUTION AUTHORIZING AND DIRECTING THE CITY ATTORNEY TO DETERMINE WHAT EFFECT, IF ANY, THE CURRENT LITIGATION BETWEEN THE CITY OF NORTH MIAMI AND THE ENVIRONMENTAL PROTECTION AGENCY, ET AL, HAS ON THE RIGHTS AND OBLIGATIONS OF THE CITY OF MIAMI AND TO ADVISE THE CITY COMMISSION AT ITS NEXT REGULARLY SCHEDULED MEETING OF THE REMEDIES, IF ANY, AVAILABLE TO SAID CITY. WHEREAS, the City of North Miami has filed a Complaint for Declaratory Judgment, Injunctive Relief and Mandamus against the Environmental Protection Agency and two of its administrators, which action places in jeopardy a total grant of $86 Million to the Dade County area from the Environmental Protection Agency, of which grant $13.5 Million must be obli- gated before June 30, 1974; and WHEREAS, this Complaint by the City of North Miami could have a serious effect on the City of Miami, its departments and citizens; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Attorney is hereby authorized and directed to determine what effect, if any, the current litiga- tion between the City of North Miami and the Environmental Protection Agency, et al, has on the rights and obligations of the City of Miami and to advise the City Commission at its next regularly scheduled meeting of the remedies, if any, available to said City.
