BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI , FLORIDA: Section 1. That Ordinance No. 8224 establishing the City of Miami's Commercial Blood Donors Board is amended by changing Section 19 to read as follows: Section 19. The effective date for the establishment of the Board herein pro- vided and for the enforcement of pro- visions herein established, shall be September 30, 1974. Section 2. That this Ordinance is hereby declared to be an emergency measure on the ground of urgent public need for the preservation of peace, health, safety and property in the City of Miami; that the requirement of reading this Ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission. Section 3. If any section, sentence, clause, phrase or wore of this ordinance is for any reason held or declared to be unconstitutional, inoperative or void, such holding or in-- valid:�ty shall not affect the remaining portions of this Ordinance, z.nd it shall be construed to Lave been the intent_ of the Com- mission of the City of Miami to pass this Ordinance without such -1- unconstitutional, invalid or inoperative part therein; and the remainder of this Ordinance after the exclusion of such part or parts shall be deened and held to be valid as if such parts had not been included therein. E 3: Cr:CLC):,'J7C As you directed I checked with the City Clerk's Office and I was advised that Ordinance 8224(Blood banks) was amended by Ordinance 8237 (Section 19) passed on February 28, 1974, pro- viding that enforcement of Ordinance 8224 will b: effective on May 10, 1974. The Fire Rescue Squad habitually rends me copies of all rescue reports which can he definitely tied to Blood Banks. 1 have received only one (1) such rescue report since my last report; copy is attached hereto. Also attached hereto are copies of a Dade County Department of Public Health Report concerning enforcement experience by the County in reference to Blood Banks; a copy of a memorandum report from the State of Florida Department of health and Rehabilitative Service and a dr.aft of a resolution which apparently will be con- sidered by the State Legislature. At my request the City of Miami Police Department conducted a survey of Blood Banks in the City over the weekend of April. 26, 27, and 28. Most reports were negative, however, I attach four (4) memorandum reports addressed to Chief Fox, which I believe are informative. I wish to point out that the Police Department responded to my request for a check on Blood Banks with a great deal of cooperation and I believe they should be thanked for their cooperation and for their effective procedure. I also contacted Reverend Rudolph McKinley of the First United Methodist Church of Miami for his comments on the natter of 33looci Banks. Reverend McKinley was unable to pinpoint any spac i fic in- TO: John S. Lloyd City Attorney RR: Survey of B1oocl Banks stances about: which he had any complaint hut- he did state that, shortly after the County Blood Bank Control began there was some improvement. IIowever, the ni.t:u;l.Lion has again deteriorated and the traffic in the neighborhood is just as it was before Blood Pant: Control. Iiis primary complaints were drunks hanging around the Blood Bank waiting for its 7:30 a.m. opening and also drunks trying to get i.riLo the Blood Bank after its closing at appro :imately ^ : 00 p.m. Ad- ditionally, he states that drunks are also "lying around" in the area and in general the Blood Bank is attracting the type of customers who are causing a serious deterioration in the entire neighborhood. INVESTIGATORS NOTE: Reverend McKinley's complaint about drunks hanging around the arca is apparently substantiated by the attached police memos. The attached statistical report from the County indicates a great deal of effective control insofar as the drawing of blood is concerned. In my opinion, the complaints may be summarized by stating a direct quotation from Reverend McKinley: "All there drunks hanging around here constantly have just ruined the tone and appearance of the entire neighborhood." I respectfully suggest that one way to alleviate this problem would be to persuade the Blood Banks to move to a more secluded location. All instructions having been complied with, action on L-his investigation' is suspended pending receipt of further instructions.
