HomeMy WebLinkAboutR-74-0260ITEM NO. ►, Mai:/gg 4/1/74 RESOLUTION No. 7 r..4 A RESOLUTION CLOSING N.W. 4TH STREET FROM 2ND AVENUE TO 3RD AVENUE SUBJECT TO A PUBLIC UTILITY EASEMENT, AS SET FORTH HEREIN, AND WAIVING THE REQUIREMENTS OF CHAPTER 54, SECTION 54-4, OF THE CITY CODE'. r/ nh .•.V1 WHEREAS, on July 20, 1972, the City Commission adopted Resolution No. 72-456 authorizing the filing of eminent domain proceedings for the acquisition of land lying between N.W. 3rd Street and N.W. 5th Street from 2nd Avenue to 3rd Avenue for the proposed Miami Police Headquarters and Crime Prevention Facilities; and WHEREAS, the City now has fee simple title to the afore- mentioned property; and WHEREAS, on October 19, 1973, the City Commission adopted Resolution No. 73-853 authorizing the City Manager to enter into' a contract with Pancoast Architects for professional consulting services for the new, modern police headquarters building; and WHEREAS, preliminary plans prepared by Pancoast Architects indicate that the proposed building and ramps will encroach into the dedicated right-of-way of N.W. 4th Street; and WHEREAS, therefore, it is recommended by the Department of Public Works that the dedicated right-of-way of the aforementioned portion of N.W. 4th Street be abandoned subject to a public utility easement; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. L. KNOWLTON MAP OP MXAM2 as recorded in Plat Book "8", at Page 41, of the Public Records of Dade County, Plorida, run eastwardly along the southerly boundary of said Block 75N for a distance of 500.17 feet, more or less, to the southeast corner of said Block 75N; thence run southwardly along the southerly prolongation of the easterly boundary of said Block 75N for a distance of 50.00 feet to the northeasterly corner of Block 88N of said A. L. KNOWLTON MAP OF MIAMI; thence run westwardly along the northerly boundary of said Block 88N for a distance of 500.17 feet, more or less, to the northwest corner•of said Block 88N; thence run northwardly along the northerly prolongation of the westerly boundary of said Block 88N for a distance of 50.00 feet to the Point of Beginning, be, and the same is hereby, closed and abandoned as a public right-of-way subject to a 20-foot wide public utility easement whose center line is more particularly described as follows: Commencing at the northwesterly corner of Block 88N, A. KNOWLTON MAP OF MIAMI as recorded in Plat Book "B", at Page 41, of the Public Records of Dade County, Florida, run northwardly along the northerly pro- longation of the westerly boundary of said Block 88N for a distance of 19.08 feet to the point of intersection with a line 19.08 feet northerly of, and parallel with, the northerly boundary of said Block 88N, said point of intersection being the Point of Beginning of the hereinafter described center line; thence run eastwardly along a line 19.08 feet northerly of, and parallel with, the northerly boundary of said Block 88N for a distance of 500.17 feet, more or less, to a point of intersection with the northerly prolongation of the easterly boundary of said Block 88N, said point being the easterly terminus of the above described center line. Section 2. That insofar as the closing of the afore- mentioned portion of N.W. 4th Street is concerned, the require- ments of Chapter 54, Section 54-4, of the City Code be, and the same are hereby waived. - 2 PASSED AND ADOPTED this //'_ ,. day of 1974.
