A RESOLUTION RATIFYING AND CONFIRMING THE ACTION
OF THE CITY MANAGER IN ACQUIRING THE PROPERTY
INVOLVED IN CIRCUIT COURT CASE NO. 73-15433,
CITY OF MIAMI, FLORIDA vs. COCONUT GROVE MARINE
PROPERTIES, INC., formerly known as COCONUT GROVE
MARINA. INC., et al. BY SATISFYING THE JUDGMENT
FOR $950,000.00 AND ALLOCATING THE SUM OF
$1,175,000.00 FROM THE 1972 PARK AND RECREATIONAL
FACILITIES BOND FUND TO ACQUIRE SAID PROPERTY AND
FOR COSTS INCIDENTAL TO THE ACQUISITION OF SAID
PROPERTY.
WHEREAS, the City of Miami filed an action in the
Circuit Court of the Eleventh Judicial Circuit in and For
Dade County, Florida in Eminent Domain, for the acquisition
of property owned and occupied by Coconut Grove Marine Properties,
Inc., formerly known as Coconut Grove Marina, Inc. said case
styled as No. 73-15433, City of Miami, Florida vs. Coconut
Grove Marine Properties, Inc., formerly known as Coconut
Grove Marina, Inc., et al.; and
WHEREAS, after negotiation Coconut Grove Marine Properties,
Inc., formerly known as Coconut Grove Marina, Inc. have agreed
to a figure of $950,000.00 as the price for the aforesaid
property, which figure is the appraised value of the property
by the appraiser employed by the City of Miami; and
WHEREAS, pursuant to said agreement, after authorization
by the City Commission of the City of Miami, a Judgment was
entered in the cause awarding the property to the City of Miami
for the sum of $950,000.00; and
WHEREAS, the City Manager, pursuant to the terms of
said judgment has acquired the property by payment of said sum
to the defendant, COCONUT GROVE MARINE PROPERTIES, INC., formerly

WHEREAS, there will be certain other incidental eXpensee
in connection with the acquisition of the property;
NOW, THEREFORE, BE IT RESOVVED BY THE COMMISSION OF' 1'HE
CITY OF MIAMI, FLORIDA:
Section 1. The action of the City Manager in acquiring
the property involved in Circuit Court Case No. 73-15433 styled
CITY OF MIAMI, FLORIDA vs. COCONUT GROVE MARINE PROPERTIES, INC.,
formerly known as COCONUT GROVE MARINA, INC., et al. by payment
of $950.000.00 pursuant to a Judgment in the Eminent Domain
action filed on behalf of the City of Miami, is hereby ratified
and confirmed.
Section 2. The sum of $1,175,000.00 is hereby allocated
from the 1972 Park and Recreational Facilities Bond Fund to satisfy
the Judgment awarding the property to the City of Miami and ac-
quiring the property and for other costs which are incidental
to the acquisition of the property. PASSED AND ADOPTED this 027 day of AFse40.90.7,
1974.
