A RESOLUTION AUTHORIZING THE DIRECTOR
OP FINANCE TO PAY TO NAT HARRISON
ASSOCIATES, INC. WITHOUT THE ADMISSION
OF LIABILITY, THE SUM OF $9,188.99 IN
FULL SETTLEMENT OF ITS CLAIM AGAINST
THE CITY OF MIAMI FOR VANDALISM ON
THE MIAMARINA PROJECT, UPON THE EXECU-
TION OF A RELEASE AND SATISFACTION OF
JUDGMENT RELEASING THE CITY OF MIAMI
FROM ALL CLAIMS AND DEMANDS AS TO THE
VANDALISM CLAIM HEREIN ONLY.
WHEREAS, the Plaintiff, NAT HARRISON ASSOCIATES, INC.,
filed a claim against the City of Miami in February of 1971,
claiming, among other items, vandalism on the project at the
Miamarina; and
WHEREAS, in the course of this litigation, it became
evident.: that the City of Miami had no defense to the vandal-
ism claim herein in that the City had failed to provide
insurance coverage as to the vandalism on the project, as
required by the written contract between the parties; and
WHEREAS, subsequently, Trial counsel agreed it would serve
the best interests of the City to remove that issue from the
cause and to consent to judgment in the principal sum of
$7,657.49 together with statutory six percent (6%) interest
thereon from October 1, 1970 through February 1, 1974, amount-
ing to $1,531.50, totalling $9,188.99;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. That the Director of Finance be and he is
hereby directed to pay to NAT HARRISON ASSOCIATES, INC.,
without the admission of liability, the sum of $9,188.99
in full settlement of its claim against the City of Miami
for vandalism on the Miamarina project, upon the execution
of a release and satisfaction of judgment releasing the
City of Miami from all claims and demands as to the
vandalism claim herein only.
