WHEREAS, the City Commission fi ds and determines that the filming of commercial motion prictures of cts the health, property, safety, welfare and morals of the citizensf the City of Miami, Florida. NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That the foregoing recital i hereby adopted as a portion of this ordinance. Section 2. Section No. 40 of Article 4 of\he compre- hensive zoning ordinance No. 6871 of the City of Miami Florida entitled "Commercial Motion Pictures" is hereby enacteelko read A, � ..••- Y ITEM 0._: do6Nr INDEX 0066 atriev as follows: Section 40, Article 4 "Commercial Motion Pictures" "The filming of motion pictures for dottercisl pur- poses is hereby prohibited in all residential zones in the City of Miami except by special resolution of the Commission; further providing that the Commission shall issue aforesaid special resolution only after the determination of the impadttan the health, safety, welfare and morals of the community or area to be affected, to include but not to be limited to such factors as: 1) Vehicular and pedestrian flow of traffic, 2) Noise and Pollution, 3) Effect on the neighborhood, 4) Length of time required for filming, 5) Disruption of community and/or disruption of residential living". Section 3. It is the intention of the City Commission and it is hereby ordained that the provisions of this ordinance shall become part of the Comprehensive Zoning Ordinance of the City of Miami, Florida; that the Sections of this ordinance may be re- numbered or relettered to accomplish such intention and that the word "ordinance" may be changed to "section" "article" or other appropriate word. Section 4. If any section, subsection, sentence, clause or provision of this ordinance is held invalid the remainder of this ordinance shall not be affected by such invalidity. Section 5. All ordinances, code sections or parts there- of in conflict herewith, insofar as they are in -conflict, are hereby repealed. PASSED on first reading by title only this day of , 1974.
