A RESOLUTION AUTHORIZING THE DIRECTOR OF
FINANCE TO PAY TO JORN GUY, INCINERATOR
STOCER IN THE DEPARTMENT OF SANITATION,
WITHOUT THE ADMISSION OF LIABILITY, THE
SUM OF $1500.00 IN FULL AND COMPLETE SETTLE-
MENT OF HIS CLAIM AGAINST THE CITY FOR AL-
LEGED LOSS OF WAGES SUFFERED DURING THE
PERIOD BEGINNING APRIL 7, 1973 and ENDING
THE 5TH DAY OF SEPTEMBER, 1973, BY REASON
OF MR. GUY'S SUCCESSFUL APPEAL TO THE CIVIL
SERVICE BOARD OF HIS DISMISSAL BY C. R. JONES,
DIRECTOR OF THE DEPARTMENT OF SANITATION,
SAID APPEAL HAVING BEEN UPHELD BY THE CITY
MANAGER.

WHEREAS, JOHN GUY, Incinerator Stoker in the Depart-
ment of Sanitation, City of Miami, was dismissed from his
employment upon written charges by C. R. JONES, Director of
the Department of Sanitation, effective April 7, 1973; and
WHEREAS, JOHN GUY did, pursuant to Rule XVI, Section 3,
appeal his suspension to the Civil Service Board; and
WHEREAS, the Civil Service Board did find that there
were extenuating circumstances justifying the reversal of
Mr. John Guy's dismissal; and
WHEREAS, the City Manager concurred in the decision
of the Civil Service Board and ordered Mr. Guy reinstated to
his employment effective September 5, 1973; and
WHEREAS, an employee of the City of Miami who is
dismissed from his employment and subsequently restored to
said employment through an appeal to the Civil Service Board
is entitled to the difference between the wages he would have
earned had he been continuously employed by the City of Miami
and the wages he earned or should have earned during Itheperiod
that his appeal was pending; and

WHEREAS, Mr. John Guy, his attorney and the City
Manager are in agreement that a fair and appropriate amount
of this difference is $150 QO;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI:.
Section 1. That the Director of Finance is hereby
authorized and directed to pay to JOHN GUY, without the ad-
mission of liability, the sum of FIFTEEN HUNDRED DOLLARS
($1500.00), in full and complete settlement of his claim
against the City of Miami for alleged damages sustained by
him by the loss of wages during the period in which his appeal
from dismissal as an employee of the City of Miami was pending,
upon the execution of a Release releasing the City of Miami
from all claims and demands.
