RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY ATTORNEY
TO DISMISS THE LAW SUIT AGAINST THE ST. JOE •'►(3%1
PAPER COMPANY FOR THE ACQUISITION.OF
BALL POINT PROPERTY, ON THE THAT THE
ATTORNEYS FOR THE ST, JOE PAPER COMPANY IN
THIS LAW SUIT ACCEPT THE SUM OF $100,000 AS
ATTORNEYS' FEES, AND A SUM IN ADDITION NOT
TO EXCEED $25,000 FOR EXPENSES, IN RETURN
FOR A COMPLETE RELEASE RELEASING THE CITY
OF MIAMI FROM ALL CLAIMS FOR ANY DAMAGES
THAT THE ST. JOE PAPER COMPANY MIGHT POSSIBLY
HAVE AGAINST THE CITY OF MIAMI.
WHEREAS, based on the opinion of the bond counsel, the
City Attorney, the City Manager and the City's appraisers, that
the City of Miami does not have sufficient funds to complete the
acquisition of the Ball Point Property;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. The City Attorney is hereby authorized to
dismiss the law suit against the St. Joe Paper Company for the
acquisition of the Ball Point Property, on the that the
attorneys for the St. Joe Paper Company in this law suit accept
the sum of $100,000 as attorneys' fees, and a sum in addition
not to exceed $25,000 for expenses, in return for a complete
release releasing the City of Miami from all claims for any
damages that the St. Joe Paper Company might possibly have against
the City of Miami.
PASSED AND ADOPTED this 15th day of January, 1974.
