RESOLUTION NO.
A RESOLUTION GRANTING A "CONDITIONAL tJSE'
AS PROVIDED IN ORDINANCE NO. 6871, ART'I-LE VI,
Section 1 (4-A)(a), TO PERMIT CONSTRUC ION OF
PLANNED UNIT DEVELOPMENT ON LOT 4, B ' 7, ttEW
GARDENS (8-9), LOCATED AT 2920 N.W. 4TH STREET,
WITH 5-UNITS IN 3 BUILDINGS, AS PER PLAN ON FILE
IN PLANNING BOARD OFFICE, ZONES R- (TWO-FAMILY)
DISTRICT.
WHEREAS, the City Planning a . Zoning Board of the
City of Miami, at its meeting held o December 10, 1973,
passed and adopted by a 7 to 1 vote (one member absent) its
Resolution No. 73-257, recommend' g granting a "conditional
use" as provided in Ordinance 16. 6871, ARTICLE VI, Section 1
(4-A (a), as hereinafter set/#orth; and this Commission deems
it advisable to the public:konvenience and welfare and finds
that the use will not befiletrimental or injurious to the
character of the devel
ent of the immediate neighborhood;
NOW, THEREF;bRE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI,-JLORIDA:
Sectio 1. That the application for a "conditional
use" as provid-% in Ordinance No. 6871, ARTICLE VI, Section 1
(4-A (a), to •ermit:construction of Planned Unit Development on
Lot 4, Blo• 7, KEW GARDENS (8-9), located at 2920 N.W. 14th
Street, ith 5-units in 3 buildings, as per plan on file in
Planning Board Office, zoned R-2 (Two -Family) District, be and
the ame is hereby granted.
Section 2. This conditional use shall become null
d void unless the use is commenced within six months of the
effective date of this Resolution. Upon application, the
City Manager may, after review and determination that substantial
progress has been achieved by the applicant in terms of project

planning, extend the expiration date of the conditional use
for an additional period of time not to exceed one (1) year.
Said extension request shall be filed with the City Manager two
(2) weeks prior to the expiration date of the initial six (6)
months effective period of the conditional use.

The Miami Planning Board, at its meeting of December 10, 1973,
Item #9, following an advertised Hearing, adopted Resolution No.
73-257 by a 7 to 1 vote (one member absent), recommending "Conditional
Use" as listed in Ordinance No. 6871, ARTICLE VI, Section 1 (4-A)
(a), to permit construction of Planned Unit Development on Lot 4,
Block 7, KEW GARDENS (8-9), located at 2920 N. W. 14th Street, with
5-units in 3 buildings, as per plan on file in Planning Board Office,
zoned R-2 (Two -Family).
Nine objections were received in the mail.
A RESOLUTION to provide for this "Conditional Use" has been prepared
by the City Attorney's office and submitted for consideration of the
City Commission.
