A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI, DETERMINING AND FINDING THE
NECESSITY FOR A PUBLIC PURPOSE IN ORDER. TO
PROVIDE FOR EXPANSION OF EXISTING PARK
FACILITIES AT KIRK MUNROE PARK, TO ACQUIRE
BY CONDEMNATION OR OTHERWISE THE FEE
SIMPLE TITLE TO CERTAIN LANDS DESIGNATED
HEREIN AND DIRECTING THE DEPARTMENT OF
LAW OF THE CITY OF MIAMI TO INSTITUTE AND
PROSECUTE TO A CONCLUSION ALL OF THE
NECESSARY LEGAL ACTIONS TO ACQUIRE THE
FEE SIMPLE TITLE TO THIS PROPERTY AS SOON
AS IT IS LEGALLY POSSIBLE, INCLUDING THE
FILING OF THE DECLARATION OF TAKING AND
THE POSTING OF THE NECESSARY BOND.
WHEREAS, the City of Miami is empowered to acquire in fee
simple by condemnation or otherwise, property real or personal, or any
estate or interest therein for any of the purposes of the City; and
WHEREAS, the acquisition of the following described property
has been found, after due consideration, to be necessary and for a public
purpose to provide for park and recreational facilities; and
WHEREAS, it is necessary that appropriate steps to acquire
the described property be taken so that said property may be made ready to
accommodate the public need for additional park facilities for the expansion of
Kirk Munroe Park;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:
Section 1. It is hereby determined and found necessary for a
public purpose in order to provide for additional park facilities for the expansion
of Kirk Munroe Park that the following property be acquired in fee simple by
gift, purchase, or condemnation, to wit:
Lots 5 and 6 (less N 5") and 19 and 20 (less S 5')
in Block 1 of CHARLES FROW SUBDIVISION,
Plat Book 13, Page 53.

Section 26 That the City of Miami, Florida, its agents and
employees be and they are hereby directed to acquire by gift, purchase, or
condemnation, the property described in Section 1 above, the fee simple title
to the above described property as soon as it is legally possible, including the
filing of a declaration of taking and utilization of any and all statutes of the
State of Florida applicable thereto.
Section 3. That the City of Miami, its employees and agents
be and they are hereby authorized and directed to incur all the necessary
expenses by way of surveys, abstracts of title, and in the acquiring of the
other information necessary to institute and maintain said condemnation
proceedings.
