RESOLUTION NO. 7 ' /7
A RESOLUTION AUTHORIZING THE DIRECTOR
OF FINANCE TO ACCEPT THE SUM OF $60,000.00
IN FULL AND COMPLETE SETTLEMENT IN THE
CLAIM OF THE CITY OF MIAMI VS. KONONOFF,
SMITH, FAY, SPOFFORD & THORNDIKE, AND
AUTHORIZING THE CITY MANAGER AND THE CITY
CLERK TO EXECUTE A RELEASE RELEASING THE
SAID DEFENDANTS FROM ANY FURTHER CLAIMS
AND DEMANDS ARISING OUT OF THE DAMAGES TO
THE CITY OF MIAMI COMPLAINED OF HEREIN.
WHEREAS, a cause of action was filed in 1964 by the
City of Miami versus Smith, Kononoff, Fay, Spofford & Thorn -
dike due to architectural design negligence in the Coconut
Grove Incinerator; and
WHEREAS, due to the excellent efforts of Building Depart-
ment Director, Robert Ferencik, it was determined that the
City's out-of-pocket expenses in this matter amounted to
$57,250.72; and
WHEREAS, an offer of settlement in the amount of $60,000.00
has been made to the City of Miami and the City Attorney of the
City of Miami has advised that it is in the best interest of
the City of Miami to accept said offer of $60,000.00 in full
and complete settlement of the above claim;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MMAMI, FLORIDA:
Section 1. That the Director of Finance is hereby
authorized and directed to accept the sum of $60,000.00 in
full and complete settlement of the claim of the City of Miami

versus Smith, Kononoff, Fay, Spofford and Thorndike, and
authorizing the City Manager and the City Clerk of the City
of Miami to execute a release releasing the Defendants from
any and all claims and demands arising out of the damages
to the City of Miami in the above matter.
