RESOLUTION NO.
15-1149
A RESOLUTION AUTHORIZING THE DIRECTOR OF
FINANCE TO PAY ATTORNEYS' FEES IN THE AMOUNT
OF $2,400.00 TO THE LAW FIRM OF TURNER i
SHAPIRO ARISING FROM A CONDEMNATION ACTION
CITY OP MIAMI V. GISELE FASHIK, ET AL., CASE
NO. 74-21840, ALSO KNOWN AS AFRICAN SQUARE;
AND FURTHER AUTHORIZING THE ALLOCATION OF
SAID FEES FROM THE PARKS FOR PEOPLE BOND FUND.
WHEREAS, by Resolution No. 74-342, the City Commission
directed the City Attorney to acquire by condemnation the property
described in said Resolution in order to complete the African Square
facility; and
WHEREAS, by statute the City of Miami, the condemning
authority, is required to pay attorneys' fees and costs arising out
of this condemnation action; and
WHEREAS, the law firm of Turner and Shapiro was retained
by the Lessee of Parcel No. 7059-3; and
WHEREAS, by court order, after a hearing on
defendant's Motion to Tax Attorneys' Fees, Turner and Shapiro, as
attorneys for Defendant, Dr. Alfred J. Nadler, as lessee of Parcel
No. 7095-3, was awarded attorneys' fees in the sum of $2,400.00;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION

Section 1. The Finance DiITErector and he is hereby
authorized and directed to pay to the law firm of Turner and Shapiro,
as reasonable attorneys' fees, the sum of $2,400.00.
Section 2. The Finance Director be, and he is
hereby authorized to allocate the aforesaid amount from the Parks for
People Bond Fund.
