WHEREAS, the Miami Zoning Board at its meeting of
October 20, 1975, Item No. 8, following an advertised hearing,
opted Resolution No. ZB 144-75 by a 7 to 0.vote recommending
change of zoning classification as hereinafter, set forth; and
WHEREAS, it is deemed advisable in the best interest
of the general welfare of the City of Miami and its inhabitants
to grant a change in zoning classification, as hereinafter set
forth
NOW, THEREFORE, BE IT ORDAINED. BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Ordinance No. 6871, the Comprehensive
Zoning Ordinance for the City of Miami, be and the same is hereby
amended by changing the zoning classification of Lot 3i Block 1,
WESTMORELAND FIRST ADD (3-33), being South of 810 S.W. 12th Avenue,
from R-2 (Two Family), to C-4 (General Commercial), subject to
dedication of right-of-way OF.712 FEET,
and by making
the necessary changes in the zoning district map made a part of
said Ordinance No. 6871 by reference and description in Article
III, Section 2 thereof..
Section 2. A11'Laws:or parts of laws in conflict,
erewith be and the same are hereby repealed insofar as they are
n conflict,

that's a Cass parked alongside the curb and I didn't pew, it there

Now ' ' have the option now, we have a building of apnrnxirnately
7200 sq. ft., it covers one entire lot. That WAS the old Linduley
Lumber duildinl. Next door to it in the lot -- now the Lindsley Lumber
building is en a C-4 lot, that's Lot 2. Lot 3 that you see marked up
there, the lot that we have the application in for, is currently zoned
R-+. Of course we've not an R-3 usage since it adjoins a C-4. What
we want to do is take down this old building and build -- if you'd like
to see it, this i. what I went over with Mr. Whipple. (He shows the
Board a sketch) . What wo WiliMpS do is to take clown the old building
and that's the layout that weave of some retail stores that we put on
the property and, if I recall, it shows about 5600 sq. ft. of building.
So, we'll actually be putting up less building on the .wo lots than we
now have on the one lot. Remember, there's 7200 ft., we're reducing it
to about 5600 sq. ft.

Mr. Simon's problem with this dedication. Are you aware, Mr. Simon,
that the dedication is only up to the base building line and you cannot
utilize anything outside the base building line anyway.
Mr. Simon: I'm aware of that, yes.
Mr. Davis: It's just the same as if you didn't have the property
so the City is asking for this dedication to align their dedications. It's
the only way they ever get dedications, and this is dedicating the area
outside the base building line towards the center of the street, and it's
an area that the property owner cannot use for setbacks or anything rise.
