Resolution Authorizing Execution
of Termination Agreement with
D.O.T. - Biscayne Boulevard
,.„t Drainage (Section 87030-6512)
City Resolution No.. 42380, passed and adopted April 15, 1971, authorized
the City Manager to execute a "Utility Relocation Agreement" requested
by the Florida Department of Transportation (D.O.T.), this being oc-
casioned by the City's existing sanitary set•wers lying in the path of
the subject storm sewer system proposed by the D.O.T.
The D.O.T. deckled that this agreement should be terminated since the
maintenance of sanitary sewers is now the function of the Miami -Dade
Water and Seiner Authority and, accordingly, forwarded to the City for
execution and return four sets or an agreement that will release the
City of Miami from the terms of the aforesaid agreement.
It is now in order for the City Commission to authorize and direct the
City Manager to execute said termination agreements and deliver the
executed instruments to the D.O.T.
THE DEPARTMENT OF PUBLIC WORKS RECOMMENDS ADOPTION OF THE RESOLUTION
AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE FOUR SETS OF
AGREEPfENTS AS REQUESTED BY THE DEPARTMENT OF TRANSPORTATION TERMINATING
THE JUNE 1, 1971 "UTILITY RELOCATION AGREEMENT" RELATING TO THE BISCAYNE
BOULEVARD DRAINAGE SYSTEM (SECTION 87030-6512) PROPOSED BY THE D.O.T.;
AND DIRECTING THAT THE EXECUTED INSTRUMENTS BE FORWARDED TO THE D.O.T.
FOR FURTHER PROCESSING.

WHEREAS, the State of Florida Department t►f Transportation has halted and proposes to ►onstruet or

ANI► WHEREAS, in order for the State of Florida Department of Transportation to further and complete said
project, it is necessary that certain utilities andli nr f'acilitivs within the. Right -of -Way limits of said State Road
5 , be adjusted, changed or relocated,
AND WHEREAS, AS, the State of Florida Department of Transportation having requested the City of
, Florida. to ext'eute and deliver to the. State. of Florida Department of Transportation
a Utilities Agreement, agreeing to make or cause to he matte such adjustments, changes or relocations of said
