OP MIAMI COMPREHENSIVE 20NIN'C ORDINANCE NO, 6871, ARTICLE XX LIGHT INDUSTRIAL - DISTRICT, SECTION 1 USE.RECULATIONS, TO EXCLUDE PERMANENT LIFE -ABOARD VESSELS EXCEPT AS REQUIRED FOR wORX OR SECURITY PURPOSES; REPEALING ALL ORDINANCES, CODE SECTIONS, OR PARTS TH EREOFCINTCONILICT INSOFAR AS THEY ARE IN CONF , A SEVERABILITt PROVISION, Whereas, the City of Miami Planning Advisory Board at its meeting of September 3, 1975, Item No. 5, following an advertised hearing, adopted Resolution No. PAB 58-75 by a 7 to 0 14 ' vote recommending amendment to Ordinance N . 6871, Article XX'- 15 Light Industrial - I-1 District - Section 1 - Use Regulations as hereinafter set forth; and 17 WHEREAS, the commission deems it advisable and in the 18 best interest of the City of Miami and its inhabitants to 19 amend said Ordinance as hereinafter set forth; 20 NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF 21 THE CITY OF MIAMI, FLORIDA:' 22 Section 1. Ordinance No. 6871, Article XX - Light 23 Industrial - I-1 - District - Section 1 - Use Regulations Sub- 24 section (5) be, and the same is herebyamended to read as -follows: 25 (5) Accessory uses and structures, not including permanent live -aboard vessels, 26 except as required for work or security purposes. 27 Section 2. All laws or parts of laws in conflict 16 28 29 30. 31 32 33 herewith be, and the same are hereby repealed insofar, as they are in conflict. 34 35' 36 3 4 7 10 11 12' 13 14- 15 16 17 18 19 20. 'W.'Andrews City Manager or 1r5 It in No. • , Octohc•r 9, 1975 The proposed amendments to the Zoning Ordinance pertaining to the Wet Storage of Vessels in Miami are a result of the need to establish standards and controls for the wet storage of vessels 16 feet and over in length within City of Miami waterways and water areas: to deterrnint• what uses, activities, services and facilities will be allowed or required in conjunction with this wet storage: and to provide for the development of additional, safe and well - kept wet storage facilities. The amendments do not intend to supersede any national, state, or other local laws that are applicable during officially declared periods of hurricane alert. Over the last two years, representatives of the Planning Department, the Building Departrnent, the Office of Hearing Administration. the past Depart - merit of Yachts and Docks and other City Departments have been meeting with committees of the Marine Council of Greater Miami, representatives of various homeowners associations, faculty from the University of Miami and others in preparing the recommended amendments. Specifically, the amendments s address the following issues: 1. the maximum length of piers 2. minimum fairway widths on navigable waterways 3. on -site parking, open space, sanitary and safety provision in conjunction with dockage 4. procedures and permits for improving existing dockage facilities 5. activities and structures permitted or prohibited in conjunction with wet storage (%• the docking on City o._: r.t.'? land or mooring ovt. r f ity._,,,•: re f'ay bottom land 7. the number and type of vessels pvrntitt.:d in each zoning district g. additional uses on facilities related to dockage allowed in each zoning district 9. amortization of nun -conforming uses 10. property owners' responsibilities i 1. side property tine setbacks for flocking.
