WHEREAS, the City of Miami. Planning Advisory Board at its meeting of September 3, 1975, Item. No. 5, following an advertised hearing, adopted Resolution No. PAB 58-75 by a 7 to vote recommending amendments to Ordinance No. 6871, Article ViI Low Density Multiple -R-3 District, Section 1 - Use Regulations as hereinafter set forth; and WHEREAS, the Commission: deems it advisable and in the best interest of the City of Miami and its inhabitants to. amend said Ordinance as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 6871, Article ViI - Low Density Multiple - R-3 District, Section 1 - Use Regulations. be and the same is hereby amended by adding new sub -sections (5-A), (5-B a & b) and(6-B) as follows: (5-A) Wet dockage or moorage of vessels sixteen (16), feet and over in length, as an. accessory use to the principal use, provided that the total number of slips does not exceed more than twenty (20) percent of the total number of dwelling units in facilities. with more than twenty (20) slips. Maxittum density permitted is the takitum use density allowed ih the district. The clocking of one (1) or, : more permanent live -aboard vessels is subject to the on -site parking, open space, sanitary and safety provisions required in Artici.e IV, Section 23, Subsections (7) and (8) of the Ordinance. (b) On Sites With existing dwelling units. Maximum permittedis either the difference between the maximum use density allowed in the district and the actual density or one (1) permanent live -aboard vessel for. every six thousand (6,000) square feet of lot area, whichever is less. In no case, shall the use density of the', zoning district be exceeded by the addition of permanent live -aboard vessels. Thedocking of five (5) or more permanent live -aboard vessels is subject to the on -site parking, open space, sanitary and safety provisions required in Article IV, Section 23, Sub -Sections (7) and 18) of the Ordinance (6-B) (b) 1. Wet dockage or moorage of vessels sixteen (16) feet and over in length, representing more than (20) percent of the total number of existing dwelling units in accessory use facilities with more than twenty (20) slips. 2. Commercial marinas, subject to on- site parking open space, sanitary andsafety requirements contained. in Article IV, Section 23, Sub -sections (7) and (8) of the Ordinance. Section 2. All laws or parts of laws in conflict herewith be, and the same are hereby repealed insofar as they are in conflict. Section 3. 'W.'Andrews City Manager or 1r5 It in No. • , Octohc•r 9, 1975 The proposed amendments to the Zoning Ordinance pertaining to the Wet Storage of Vessels in Miami are a result of the need to establish standards and controls for the wet storage of vessels 16 feet and over in length within City of Miami waterways and water areas: to deterrnint• what uses, activities, services and facilities will be allowed or required in conjunction with this wet storage: and to provide for the development of additional, safe and well - kept wet storage facilities. The amendments do not intend to supersede any national, state, or other local laws that are applicable during officially declared periods of hurricane alert. Over the last two years, representatives of the Planning Department, the Building Departrnent, the Office of Hearing Administration. the past Depart - merit of Yachts and Docks and other City Departments have been meeting with committees of the Marine Council of Greater Miami, representatives of various homeowners associations, faculty from the University of Miami and others in preparing the recommended amendments.
