A RELUTION AUTHORIZING THE DIRECTOR OF
FINANCE TO ACCEPT THE SUM OF 0132.02 IN
FULL AND COMPLETE SETTLEMENT IN THE CLAIM
OF THE CITY OP MIAMI VERSUS AUGUSTO ANTONIO
SANCHEZ, AND AUTHORIZING THE CITY MANAGER AND
THE CITY CLERK OF THE CITY OP MIAMI TO EXECUTE
A RELEASE RELEASING AUGUSTO ANTONIO SANCIHEZ
FROM ANY AND ALL CLAIMS AND DEMANDS ARISING
OUT OF THE ACCIDENT INVOLVED IN THE ABOVE CLAIM.
WHEREAS, a claim has been filed by the City of Miami
against Augusto Antonio Sanchez, as a result of a collision
between a City of Miami vehicle and an automobile owned and
operated by Augusto Antonio Sanchez.
WHEREAS, an offer of settlement on behalf of Mr.
Augusto Antonio Sanchez has been made to the City of Miami,
which offer is in the amount of $132.02; and
WHEREAS, the City Attorney of the City of Miami has
advised that it is in the best interest of the City of Miami
to accept said offer of $132.02 in full and complete settlement
of the above claims
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The Director of Finance is hereby authorized
and directed to accept the sum of $132.02 in full and complete settle
ment of the claim of the City of Miami versus Augus0 Antonio Sanchez,
and the City Managarand the City Clerk of the City of Miami are
authorized to execute a release releasing Augusto Antonio Sanchez
from any and all claims and demands arising out of the accident
involved in the above claim.

Resolution
Tn the following claim, a City vehicle was involved in an accident
on February 13, 1975, on Grand Avenue at its intersection with
LeJeune Road in Coral Gables, Florida.
The other vehicle involved in this accident was a 1961 Chevrolet
with 1975 registration *1-85572, owned and operated by Augusto
Antonio Sanchez and insured by Underwriters Adjusting Company.
This accident took place when both vehicles entered the inter-
section of Grand Avenue and LeJeune Road. Both driver, claimed
to have entered said intersection with the green light.
Since there were no witnesses to this accident, Underwriters
Adjusting Company have made a firm offer on behalf of their
insured to settle this claim for 50/ of the original amount
by the City. Original Amount claimed by the City $264.04.

Due to the fact that this is a case of questionable liability,
on the part of the City vehicle, and based on recommendation
of Mr. Santana of this office, as well as the doubtful legal
aspects of this case, I recommend that the above offer be
accepted in full settlement of this property damage claim.
