i(RS. STARKEVi ITAK Wometco Enterprises requested a condi; onal use to provide additional parking for the Tower Theater some time ago. The Zoning Hoard approved an application for conditional use (the use of a residential lot for parking) . Mts. Starkey said she was unable to file an appeal because she could not obtain the 104 required aignatures and did not have $30U.JJ. After the appeal period had expired Mrs. Starkey requested a personal appearance before the City Commission. She was ad- vised that nothing could be done at that time. The ovner of a chain of restaurants decided that he wished to place a restaurant on S. W. 6 Street and lease a portion of the Tower Theater parking. He was required to obtain a variance and conditional use for this parking. The Zoning Board recently approved this item. Mrs. Starkey appeared as an objector. However, she again did not take an appeal for the same reasons as before. She has again requested a personal appearance before the City Commission, however, the appeal period has again expired and there is nothing that the Commission can do at this point. Mrs. Starkey complains that certain misrepresentations were made to the Zoning Board and that because of these misrepre- sentations the City Coialission should reuest the City Attorney to file suit tor fraud for the purpose of rescinding the Zoning Board resolution granting the restaurant the parking it reuires. One of the misrepresentations claimed by Mrs. Starkey is that Alex Gordon represented to the Zoning Board that there was a letter of intent signed beteen Wometco Enterprises and the restauranteur Alen there vas in actuality a lease signed by the parties.
