FOR TIIAT PORT OF THE 10-FOOT ALLEY LYING ON THE 50UTHSIDt OF LOTS 11 THROUGH 21 INCLUSIVE AND A PORTION OF LOT lb IN BLOCK 2 OF SANDRIcOURT (3-83) , RESERVING To THE CITY OF MIAMI THE EXPRESSED RIGHT OF PERPETUAL EASEMENT IN AND To THE AFORESAI() ALLEY FOR MUNICIPAL PURP0SES AND PUBLIC UTILITIES AND FURTHER AUTHORIZTNC THE CITY MANAGER TO ENTER INTO AND ACCEPT THE COVENANT RUNNING WITH THE LAND WHICH PIi0VIDT;S THAT BIG REALTY CORP. SHALL NOT ENCROACH ON TO THE CtTY'S PERPETUAL EASEMENT. WHEREAS, Big Realty Corp. is the owner of the adjacent property on the north and south of the above captioned portion of the public ally; and WHEREAS, Big Realty Corp. has requested that the City deed a portion of the said public alley to it; and WHEREAS, liig Realty Corp. has no objections to the City's retaining a perpetual easement in and to the aforesaid described property; and WHEREAS, the aforesaid described portion of the public alley has never been used as a public alley; and WHEREAS, Florida Statute Section 255.22 provides that where f land is deeded to a municipality for a specific purpose and where said land is not used for that purpose within a five (5) year period, the municipality may, by quit -claim deed, grant said property to the adjacent property owner; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF TN C "DOCUMENT OF MIAMI, FLORIDA: ITEM NO. Section 1. The City Manager is hereby authorized and directed to execute a City deed to Big Realty Corp. for that part of the 10-foot alley lying on the southside of Lots 17 through 21 inclusive and a portion of Lot 16 in Block 2 of Sandricourt (3-83), reserving to the City of Miami the expressed right of perpetual easement in and to the aforesaid alley for euntctpat purposes and public utilities; bEX I tr L c : l;ONihi; :; N MEETING OF OCT 9 1$75 Section 2. The City Manager is hereby authorised to enter into and accept the covenant running with the land which provides that Big Realty Corp. shall not encroach on to the City's perpetual easement.
